Prosecutor Refutes 4 Points Of Objection By MSAT Lawyer Defendant For Sexual Abuse Of Santriwati

SURABAYA - The public prosecutor responded to the exception or objection filed by legal counsel M Subchi Azal Tsani alias MSAT accused of sexual abuse at a boarding school in Jombang, East Java.

In an hour-long closed-door hearing, prosecutors refuted all objections from MSAT's attorneys. One of them is related to the transfer of the trial from the Jombang District Court to the Surabaya District Court.

Tengku Firdaus, one of the prosecutors, conveyed the attorney's objection to the transfer of the trial from the Jombang District Court to the Surabaya District Court. This is based on the fatwa of the Supreme Court (MA).

"Based on the provisions of Article 5, the Supreme Court issued a fatwa to transfer the trial (from Jombang to Surabaya). So, basically there are several proposals, and these proposals are related to conduciveness and security in Jombang," said Tengku after the trial at the Surabaya District Court, Monday, August 1.

The second point is that MSAT's lawyer objected to the prosecutor's demands which were considered inaccurate and incomplete. The lawyer considered that there was no description regarding the threat of violence and violence in the charges. "Although it is not included in the exception material, but we still respond, it is included in the subject matter of the case," he said.

Another objection from MSAT's lawyers is that the charges referred to by attorneys are not clear. The attorney assesses the indictment and the full charge.

"Because there are words in the indictment that have multiple interpretations according to legal counsel. But we have already answered," he said.

Tengku said that all answers from the Public Prosecutor regarding the objection from the MSAT lawyer will be decided in the fourth trial which will be held on Monday, August 8, 2022.

"The panel of judges will make an interim decision at the hearing next week. So, reject or accept the objections from legal counsel. Also the response from us as prosecutors," he said.

At a follow-up hearing next week, said Tengku, the prosecutor will also make an answer to the attorney's objection regarding the offline trial. It will provide a written response.

"Then later there will be objections regarding the offline trial. We will respond in writing, we will submit it to the panel of judges," he said.
