MATARAM - The teenager who was involved in the burglary case against Murtede alias Amaq Sinta, with the initials H was sentenced to six months of coaching at the Special Child Development Institute (LPKA), in Central Lombok Regency, NTB.

H's legal adviser, Yan Mangandar Putra, said the verdict was read in a closed session in the Children's Courtroom of the Praya District Court.

"Basically, the sole judge Farida Dwi Jayanthi, who tried the child defendant (H, initials) found that he was found guilty of committing theft with violence in aggravating circumstances, according to the primary indictment of the public prosecutor," said Putra, who provided legal assistance through the Central Lombok Child Protection Agency (LPA), reported by ANTARA, Tuesday, July 26.

Regarding the judge's decision, he said, conveyed that H had stated that he had accepted the single judge's verdict, which was held Tuesday afternoon July 26 at the Praya District Court, Central Lombok Regency. Likewise with the statement of the public prosecutor who was represented by the prosecutor at the Central Lombok District Attorney, Vini Angeline.

"Because we and the public prosecutor state that we accept, so the decision has permanent legal force," he said.

According to information from the prosecutor's office, the follow-up to the status of the decision which has permanent legal force, the execution of the decision will be carried out on August 4, 2022.

In the trial, the prosecutor previously charged H with a prison sentence of nine months.

However, Putra and his team of legal advisers defended by explaining according to the facts of the trial that H was passive from the beginning of planning to the execution of Amaq Sinta's beheading.

"So, this H only followed the orders of the adult perpetrators and did not carry weapons and did not participate in the attack on the victim," he said.

In another fact, Amaq Sinta in the trial has also forgiven H and hopes that after serving his sentence he can immediately continue his education.

Putra also considered the single judge's decision, in this case, to be appropriate, proportional to the actions of the child, and by Law Number 11/2012 concerning the Juvenile Criminal Justice System (SPPA).

In the SPPA Law, the types of crimes against children are different from adults who are usually jailed and fined. Meanwhile, children based on the SPPA Law are criminals and action.

Reflecting on this case, he hopes that it can become a common learning material in fulfilling children's rights, as well as increasing supervision from the social environment.

"So, it's not just busy with a noise like a child-worthy city award. Hopefully, from this case there will be no more children who have the same fate as H," he said.

In this case, he from Central Lombok LPA assisted the Mataram Penitentiary Community Counselor, the Mataram UIN Mataram Legal Aid and Consultation Center, and the family of H.

H is one of the three perpetrators of the Amaq Sinta robbery. Two of his colleagues, O, and P were killed in the action, while his partner, initials W (22), is still being held at the NTB Police Detention Center.
