Hundreds Of Workers Crowd Anies' Office Today, Demand Anies Against The Administrative Court Decision Regarding The DKI UMP

JAKARTA - Hundreds of workers who are members of the Confederation of Indonesian Trade Unions (KSPI) will hold a demonstration at DKI Jakarta City Hall, Jalan Medan Merdeka Selatan, Central Jakarta today.

The initial plan was for workers to go to the office of the Governor of DKI Jakarta Anies Baswedan on Tuesday, July 19 yesterday. However, this action was postponed to today at around 10:00 WIB. Possibly, the action will also continue in front of the Jakarta State Administrative Court (PTUN).

KSPI President Said Iqbal revealed that his party had two demands in today's demonstration. The first claim, KSPI urges Anies to appeal the decision of the Jakarta Administrative Court which lowers the DKI Jakarta Provincial Minimum Wage (UMP) in 2022 to the Supreme Court (MA).

Iqbal asked Anies to appeal in order to maintain consistency on the policies that have been made. In which, Anies has issued the Governor's Decree No. 1517 of 2021 concerning the 2022 UMP in the amount of IDR 4.64 million which was issued on December 16, 2021.

"We ask the Governor of DKI Jakarta, Pak Anies Baswedan to appeal. That's the only goal. He must be committed to his decision. The government's authority could fall. Whether the Supreme Court decides otherwise, that's another matter," said Iqbal when contacted, Tuesday, 19 July.

The second claim, KSPI asked Anies to keep employers from immediately lowering the minimum wage from Rp.4.64 million to Rp.4.53 million just because there was a decision by the Administrative Court. Because, said Iqbal, until now, Anies has not revoked the Governor's Decree regarding the 2022 DKI UMP.

"As long as there is no decision at the appeal level, the old wages will still apply. The PTUN decision does not yet have binding legal force," said Iqbal.

Iqbal also asked the Indonesian Employers' Association (Apindo), which is the plaintiff for lowering the DKI UMP in the Jakarta Administrative Court, to withdraw a circular letter to employers to reduce the wages of their workers following the decision of the Jakarta Administrative Court. According to Iqbal, as long as there is no action from the DKI Provincial Government, the UMP value is still IDR 4.64 million.

"We ask Apindo not to cause a commotion. Because with the PTUN decision that is not yet binding, don't make a fuss by issuing a circular letter so that the company lowers the UMP according to the PTUN (decision). That's not allowed," he said.

The contents of the decision of the Jakarta Administrative Court regarding the DKI UMP

The DKI Jakarta State Administrative Court (PTUN) canceled the decision of the Governor (Kepgub) of DKI Jakarta Anies Baswedan regarding the 2022 Provincial Minimum Wage (UMP) whose lawsuit was filed by a number of entrepreneurs.

The decision of the Jakarta Administrative Court granted all claims from entrepreneurs. The plaintiff is the Regional Leadership Council of the Indonesian Employers Association (Apindo) DKI Jakarta.

In addition to canceling the Gubernatorial Decree, the Jakarta Administrative Court in its ruling also required Anies, as the defendant, to revoke Gubernatorial Decree No. 1517 of 2021 concerning the 2022 UMP which was issued on 16 December 2021.

Another ruling is that Anies obliges Anies to issue a new State Administrative Decree regarding the 2022 UMP based on the recommendation of the Wage Council of DKI Jakarta, namely the elements of the labor union Number: I/Depeprov/XI/2021 on November 15, 2021, amounting to Rp4,573,845.

The Jakarta Administrative Court also sentenced Anies as the defendant and the second defendants intervened jointly and severally to pay court fees of Rp642,000.
