Jakarta Administrative Court Cancels DKI Governor Anies Baswedan's Decision Regarding UMP 2022

JAKARTA - The DKI Jakarta State Administrative Court (PTUN) has canceled the Decree of the Governor (Kepgub) of DKI Jakarta Anies Baswedan regarding the 2022 Provincial Minimum Wage (UMP) whose lawsuit was filed by a number of entrepreneurs.

The Jakarta Administrative Court via the Case Search Information System (SIPP) website reported by ANTARA, Tuesday, July 12, explained that the decision granted all claims from entrepreneurs.

There is also the plaintiff, namely the Regional Leadership Council of the Indonesian Employers Association (Apindo) DKI Jakarta.

In addition to canceling the Gubernatorial Decree, the Jakarta Administrative Court in its ruling also required Anies, as the defendant, to revoke Gubernatorial Decree No. 1517 of 2021 concerning the 2022 UMP which was issued on 16 December 2021.

Another ruling is that Anies obliges Anies to issue a new State Administrative Decree regarding the 2022 UMP based on the recommendation of the DKI Jakarta Wage Council, namely the elements of the labor union Number: I/Depeprov/XI/2021 on November 15, 2021, amounting to Rp4,573,845.

The Jakarta Administrative Court also sentenced Anies as the defendant and the second defendants intervened jointly and severally to pay court fees of Rp. 642,000.

Previously, the Governor of DKI Jakarta, Anies Baswedan, revised the Governor's Decree No. 1395 of 2021 regarding the 2022 UMP to become Governor's Decree 1517 of 2021.

In the revision, Anies raised the 2022 Provincial Minimum Wage (UMP) in DKI by 5.1 percent to Rp4,641,854 from the previous stipulation of only 0.85 percent of Rp4,453,935 on Saturday (12/18/2021).

Thus, the increase in the 2022 UMP is greater by IDR 225,668 than the 2021 UMP which is IDR 4,416,186 and also larger than the nominal increase previously set for the 2022 UMP of IDR 37,749.

With the revision and increase in the 2022 UMP, the entrepreneurs then registered a lawsuit with the Jakarta Administrative Court on January 13, 2022 with case number 11/G/2022/PTUN.JKT.

Meanwhile, General Chairperson of the Indonesian Employers' Association (Apindo) Hariyadi Sukamdani assessed that DKI Jakarta Governor Anies Baswedan had violated wage regulations related to the revision of the DKI Jakarta provincial minimum wage increase (UMP) in 2022.

Anies, he said, had violated the wage regulations, namely those contained in Government Regulation (PP) Number 36 of 2021 concerning Wages.

"In this case, Apindo DKI Jakarta has expressed an objection because if it is done it will violate PP 36/2021," he said in an online press conference quoted by Antara, Monday (12/20/2021).
