Draft RKUHP: Torturing Animals Until Seriously Injured And Dead Can Be Sentenced To Jail

JAKARTA - Animal torturers can be subject to criminal sanctions if they refer to the Draft Criminal Code (RKUHP). They can even be imprisoned for up to 1 year and 6 months if the tortured animal is seriously injured, disabled, or dies.

The following reads Article 339:

"If the act as referred to in paragraph (1) results in the animal being sick for more than 1 (one) week, disabled, seriously injured, or dead, the animal will be punished with imprisonment for a maximum of 1 (one) year and 6 (six) months or a fine for a maximum category of 1 (one) year. III," as quoted from the draft RKUHP on Wednesday, July 6.

Meanwhile in Paragraph (1) Article 339 it is stated that a one year criminal sentence can be imposed on those who harm animals without a proper purpose.

This is the full text of the verse:

Convicted of committing animal abuse with a maximum imprisonment of one year or a maximum fine of category II, Anyone who: a. hurt or injure an animal or harm its health by overreaching or without proper purpose; orb. have sex with animals.

Not only sentenced, the animal is also confiscated and placed in a proper place by the state. This is regulated in Article 339 Paragraph (3).

In addition, in Article 338, people who incite animals to harm others and do not keep or report their wild pets can be sentenced to six months in prison.

Sentenced to a maximum imprisonment of 6 (six) months or a maximum fine of category II, Anyone who: a. inciting animals so as to harm people; b. inciting an animal that is being ridden or an animal that is pulling a carriage, cart, or loaded with goods; c. does not prevent animals in its custody from attacking people or animals; d. not taking proper care of wild animals that are in their care; or e. keeping a dangerous wild animal does not report it to the authorized official.

The RKUHP also stipulates criminal penalties for anyone who uses animals outside their nature to use animal organs for improper purposes. This is regulated in Article 340.

Article 340 Paragraph 1

Sentenced to a maximum imprisonment of 1 (one) year or a maximum fine of category II, Anyone who: a. use and exploit animals beyond their natural capabilities which can damage health, threaten safety, or cause animal death; b. provide materials or drugs that can endanger animal health; orc. use of animal body parts or organs for improper purposes.

Meanwhile, parties who produce animals or animal products through biotechnology and the results endanger sustainability may be subject to a two-year sentence. The following reads the rules in Article 340 Paragraph 2 of the RKUHP:

"Everyone who applies modern biotechnology to produce transgenic animals or animal products that endanger the preservation of animal resources, public health and safety, and the preservation of environmental functions, shall be subject to a maximum imprisonment of 2 (two) years or a maximum fine of category IV. "
