JAKARTA - The Attorney General's Office has opened its voice on the release of two suspects in the Indosurya Cipta Savings and Loans Cooperative (KSP) case from the Bareskrim detention center because the 120-day detention period has expired.

The suspects were released because the case files were incomplete (P19). The Head of the Center for Legal Information (Pakuspenkum) at the Attorney General's Office, Ketut Sumedana, viewed that the end of the detention period could not be used as a basis for pressing for the settlement of case files.

"Regarding the release of the suspect by law, it can be conveyed that this cannot force the Prosecutor to state the complete case file (P-21)," said Ketut in his statement, Sunday, June 26.

Ketut said the public prosecutor was of the opinion that the case file for the suspect in the Indosurya case was declared incomplete and did not meet the formal and material requirements.

Ketut also denied that the paperwork was still in the hands of the prosecutor. This is because the Attorney General's Office has returned the files to the police investigators on June 24, 2022.

"The case file has been sent back to the investigators of the Directorate of Economic and Special Crimes of the Indonesian Police Criminal Investigation Agency (Bareskrim Polri) on Friday, June 24, 2022," he said.

Ketut said that the authority to detain a suspect should be carried out selectively. This is because the case is still under investigation and is still in the process of completing the case file.

He continued, investigators should also carry out intensive coordination and communication to anticipate errors that could occur in law enforcement.

"And the precautionary attitude carried out in research and publishing P-21 is for the protection of victims and human rights as well as minimizing unwanted things in the evidentiary process at trial," he concluded.

Previously, two suspects in the Indosurya Savings and Loans Cooperative (KSP) case were released from the detention center because their prison terms had expired. It is suspected that there were problems at the prosecutor's level because the case files had been transferred from the investigators from the Dittipideksus Bareskrim Polri to the Attorney General's Office (Kejagung).

Dirtipideksus Bareskrim Polri Brigadier General Whisnu Hermawan said when confirmed that the dossier of this case had not been returned to investigators. "Police investigators have no problems, maybe the problem is with the prosecutors," said Wisnu.

Even though the suspect was released from detention, Whisnu emphasized that the investigation of this case would continue. The three suspects are Henry Surya as the Chairman of KSP Indosurya; The Cooperative's Director, Suwito Ayub, who is still at large; and Head Admin, June Indria.
