Not Obeying Administrative Sanctions, PT KCN Permit For Marunda Coal Dust Pollution Is Revoked

JAKARTA - The DKI Jakarta Provincial Government through the DKI Jakarta Environment Agency has revoked the operational permit for PT Karya Citra Nusantara (KCN) over the case of coal dust pollution in Marunda Flats, North Jakarta.

The head of the DKI Jakarta Environmental Agency, Asep Kuswanto, said that the revocation of the permit was carried out due to not completing the administrative sanctions imposed on the loading and unloading company as the perpetrator of the air pollution.

This firm sanction is contained in the Decree of the Head of the Environmental Sub-department of the North Jakarta City Administration Number 21 of 2022 concerning the Weighting of the Application of Administrative Sanctions of Revocation of the Decree of the Head of the Environmental Management Office of the North Jakarta City of Administration Number 56 of 2014 dated January 28, 2014 concerning the Environmental Permit for Loading and Unloading Activities by PT. Archipelago Citra Works. This decree was signed on 17 June 2022.

"The revocation of this permit is because PT KCN has not fulfilled its obligations in the administrative sanctions imposed by the government Number 12 of 2022 on March 14, 2022," said Asep in his statement, Monday, June 20.

In a follow-up to the revocation of PT KCN's environmental permit, the Environmental Service will write to the Head of the Tanjung Priok Main Port Authority Office to take the necessary steps after the environmental permit is revoked in accordance with applicable regulations.

Meanwhile, Head of the North Jakarta Environmental Agency, Achmad Hariadi said, in the decision to revoke the environmental permit, PT KCN was ordered to stop all loading and unloading activities.

"With the stipulation of this decree, the environmental permit for loading and unloading activities by PT Karya Citra Nusantara is declared invalid," said Hariadi.

Previously, the Marunda Rusunawa Community Forum through LBH Jakarta revealed that Marunda Rusunawa residents still feel coal dust pollution to this day. Of the 32 sanctions points imposed by the DKI Provincial Government, it turns out that only 4 sanctions points have been followed up by PT KCN.

"Also, the four points that are adhered to are not significant in reducing environmental pollution due to coal dust which is increasingly present and living together with the residents of Rusunawa Marunda," said public attorney for the Jakarta Legal Aid Institute, Jihan Fauziah Hamdi in a statement, Wednesday, June 15.

For this matter, Jihan said that the Rusunawa Marunda Community Forum urged DKI Jakarta Governor Anies Baswedan to impose stricter sanctions in the form of freezing of business licenses to PT KCN.

Because, Article 521 of PP Number 22 of 2021 firmly regulates every business actor and/or activity that does not carry out government coercion and does not pay a late fee for implementing government coercion, its business license can be frozen.

"PT KCN's lack of seriousness in carrying out environmental restoration can be seen from the many administrative sanctions that are not adhered to, so PT KCN's business license should be frozen," said Jihan.
