Drug Dealer Free Sentence In Palangka Raya Reveals Controversy, High Court Forms Team To Examine Judges

PALANGKA RAYA - Chairman of the High Court (PT) of Palangka Raya, Central Kalimantan, Zainuddin ordered the Chairman of the District Court (PN) of the local city to immediately form an examination team against the judges who acquitted the accused drug dealer Saleh of the type of methamphetamine.

Public Relations of the Palangka Raya High Court, Wahyu Prasetyo Wibowo, accompanied by his colleague, Ajidinnor, said that the examination of the panel of judges who handled the case was to find out whether there were indications of violations in examining the case in question.

"Whether it's a violation of the procedural law, the material and the judge's code of ethics," said Wahyu in Palangka Raya, quoted from Antara, Tuesday, May 31.

Due to this verdict, a number of community organizations in Palangka Raya City held an action in front of the local District Court office and urged the judges who handled Saleh's case to be immediately deactivated.

Responding to this, Wahyu and Ajidinnor said, it is true that the authority of PT Palangka Raya can disable judges at the local PN level.

However, what must be noted is that, in accordance with Supreme Court Regulation (Perma) Number 8 of 2016 concerning Judge Supervision, that authority was exercised by the chairman of the PT after the results of the examination by the PN team found that there was a violation, so the chairman of the PT withdrew the matter.

After that, after being withdrawn, the chairman of the PT will carry out further examination of what has been examined at the PN level. After that, the results of the PT examination will be sent to the Supervisory Agency (Bawas) level.

"Because the only authority to impose punishment is at the central level, namely the Supreme Court (MA), which in this case is Bawas," he said.

With this regulation, he emphasized that PT Palangka Raya had responded to the demands of the protesters who recently held a peaceful protest in front of the Palangka Raya District Court office for the acquittal of drug defendants.

"Once again, please be understood by the protesters, that in this matter, the existing procedures will be taken. Then the punishment given is not instantaneous, it must carry out a proper examination according to the regulations in the legislation and wait for the results later," said Wahyu.
