JATIM - Workers or laborers are asked not to be afraid to report violations related to the payment of holiday allowances (THR) according to government regulations on H-7 Lebaran 2022.

This was conveyed by the Head of the Department of Manpower and Transmigration (Kadisnakertrans) of East Java Province Himawan Estu Bagijo. He encouraged workers who experienced THR problems to report them to the nearest THR Command Post.

He said that currently the East Java Province Manpower and Transmigration Office had opened 16 THR service posts in 38 offices of agencies in charge of manpower in districts/cities.

"Until today it is still safe and no complaints have come in, and we are always ready if any complaints come to us," he said.

Himawan appreciated the associations of entrepreneurs who are members of Apindo, Kadin and Forkas who are jointly committed to overseeing the provision of THR.

According to the regulations, the religious THR must be paid by employers to workers no later than seven days before Hari Raya, and cannot be made in installments, that is, it must be given in cash once.

For companies that do not comply, according to PP Number 36 of 2021 concerning Wages, Article 79, they are subject to administrative sanctions in the form of written warnings, restrictions on business activities, temporary suspension, part or all of production equipment and freezing of business activities.

"When there is a complaint, we will resolve it through the district first, industrial relations with labor inspectors belonging to the province in the region," he said.

He hopes that there will not be too many complaint reports this year, which means that it shows that the awareness of employers and workers' rights has been fulfilled in welcoming the holiday.

However, he said, the minimum number of reports that came in did not necessarily indicate the entrepreneur's awareness. It could also be because workers do not dare to report if there is a problem. "Therefore, we encourage them to report, and we are always ready to facilitate it," he said.

Meanwhile, based on the records of the East Java Province Manpower and Transmigration Office, the THR complaint reports submitted in 2021 reached 89 complaints and all of them have been resolved. "Usually, many complaints come in after Lebaran or D+7, however, we still encourage them to dare to report," he said.
