JAKARTA - The Attorney General's Office respects the decision of the Bandung High Court (PT) panel of judges which granted the death sentence to Herry Wirawan, the perpetrator of the rape of 13 female students.

"We institutionally respect the court's decision," said the Head of the Attorney General's Office for Legal Information (Kapuspenkum) Ketut Sumedana as reported by Antara, Monday, April 4.

According to him, the decision has accommodated all the demands and considerations of the prosecutor so that the AGO appreciates the duties of implementing public prosecutors in the regions.

However, said Ketut, the prosecutor's office was not satisfied with the verdict. Currently, his party is waiting for other legal remedies that will be carried out by the defendant.

"We are now waiting for the defendant's efforts to accept or apply for another legal remedy," said Ketut.

Previously, the Chief Justice of PT Bandung Herri Swantoro granted the sentence after the West Java High Prosecutor's Office appealed the decision of the Bandung District Court which sentenced Herry to life imprisonment.

"Received an appeal from the prosecutor/public prosecutor. Therefore, the defendant is sentenced to the death penalty," said Herri Swantoro in Bandung, West Java, Monday.

In his decision, the judge corrected a number of decisions of the Bandung District Court. Herry was also decided by the judge to remain in custody.

The punishment is in accordance with Article 21 KUHAP junctis Article 27 KUHAP jis. Article 153 paragraph (3) of the Criminal Procedure Code jis. paragraph (4) KUHAP jis. Article 193 of the Criminal Procedure Code jis. Article 222 paragraph (1) jis. paragraph (2) KUHAP jis. Article 241 of the Criminal Procedure Code jis. Article 242 of the Criminal Procedure Code, and PP Number 27 of 1983.

In addition, Article 81 paragraph (1), paragraph (3) in conjunction with Article 76 D of Law Number 17 of 2016 concerning Amendments to Law Number 23 of 2002 concerning Child Protection jo. Article 65 paragraph (1) of the Criminal Code, and other relevant provisions.

In addition to the death sentence, Herry was also required to pay restitution of more than Rp. 300 million. The verdict annulled the Bandung District Court's decision which previously freed Herry from the restitution sentence.

Herry was previously sentenced to life in prison by the Bandung District Court judges on Tuesday (15/2). The verdict also dismissed a number of other demands, such as demands for castration, restitution, and confiscation of assets.
