Opponents Of Pretrial Lawsuit Suspect Alleged Corruption Procurement Of AW-101 Helicopter, KPK Brings Dozens Of Evidence

JAKARTA - The Corruption Eradication Commission (KPK) is fighting a pretrial lawsuit filed by Jhon Irfan Kenway, a suspect in the alleged corruption in the procurement of the AW-101 helicopter at the South Jakarta District Court. A total of 84 pieces of evidence were brought at trial.

"KPK has submitted 84 pieces of evidence," said Acting KPK Spokesperson for Enforcement, Ali Fikri in a written statement, Wednesday, March 16.

Ali said that dozens of evidences were in the form of documents. He did not elaborate on the documents, but he made sure that everything was in accordance with the applicable regulations.

Furthermore, the anti-corruption commission denied that the detention process violated the law. Plaintiff Jhon Irfan Kenway, said Ali, was judged to be wrong in his pretrial notice in this case.

"Even though the investigation has been running for more than two years, the KPK is still authorized to carry out investigations because the provisions of the KPK Law do not require the KPK to stop the investigation," he said.

In addition, Ali also emphasized that the termination of the AW-101 Helicopter case at the TNI Puspom did not affect the handling of cases at the KPK. "Because the investigation between the KPK and the TNI Puspom was carried out separately," he said.

With these various conditions, the KPK also asked the pretrial judge to reject all of Jhon Irfan's claims. "Then, state that the process of investigating this case is legal according to law and has binding power," said Ali.

Previously reported, John Irfan Kenway filed a pretrial lawsuit against the Corruption Eradication Commission (KPK). In the lawsuit registered with Case Number 10/Pd.Pra/2022/PN JKT.SEL, several petitions were submitted.

As the applicant, he asked the judge to declare the status of the suspect invalid because the status has exceeded two years and the investigation of the suspect in the state administration has been terminated.

"Declaring the Investigation Order Number: Sprin.DIK-44/01/06.2017 dated June 16, 2017 which stipulates the applicant as a suspect by the KPK has no binding legal force," as quoted from SIPP South Jakarta District Court on Tuesday, February 8.

In addition, as the applicant, Jhon also asked the judge to cancel the blocking of assets that had been carried out. Not only his assets but also those of his biological mother.

Then, he also asked the judge to revoke the blockage of state money amounting to Rp. 139.43 billion so that it will remain in the hands of the Air Force treasury holders. The money is in the account of PT. Diratama Jaya Mandiri.

For information, this case began in April 2016 when the Indonesian Air Force purchased an AW-101 helicopter. Two companies participated in the auction, namely PT Diratama Jaya Mandiri and PT Karya Cipta Gemilang.

Then, PT Diratama Jaya Mandiri came out as the winner and increased the contract value to Rp738 billion. From the procurement project, it was detected that there was a price difference of Rp. 224 billion, which was indicated as state loss.

Regarding the allegations, the Corruption Eradication Commission (KPK) named PT Diratama Jaya Mandiri President Director Irfan Kurnia Saleh as a suspect.

Meanwhile, from the Indonesian Air Force, there are five officers who are suspects. They are the Deputy Governor of the Air Force Academy, First Marshal Fachry Adamy, who is a former commitment maker or Chief of the Procurement Staff of the Indonesian Air Force for 2016-2017 and Lieutenant Colonel of the Indonesian Air Force (Adm) WW as a former Head of Headquarters.

Furthermore, Pelda SS as Bauryar Pekas Diskuau; Colonel (Purn) FTS as former Sesdisadaau; and Marshal of the Indonesian National Armed Forces (Ret.) SB as the Special Staff of Kasau (former Asrena KSAU) were also named as suspects.
