JAKARTA - The Jakarta Corruption Court (Tipikor) has sentenced former Director of Regional-Owned Enterprises (BUMD) for the construction of Sarana Jaya, Yoory Corneles, to 6.5 years in prison plus a fine of Rp. 500 million, subsidiary to 6 months in prison.

Yoory was proven guilty of corruption in the land acquisition for the "DP 0 Rupiah Residential" project in Munjul, East Jakarta, which cost the state Rp152.565 billion.

"The defendant is sentenced to imprisonment for 6 years and 6 months and a fine of Rp. 500 million, which if not paid is replaced with imprisonment for 6 months," said Chair of the Panel of Judges Saifuddin Zuhri at the Jakarta Corruption Crime Court (Tipikor), as reported by Antara, Thursday, February 24.

The verdict is lower than the demands of the KPK Public Prosecutor (JPU) who requested that Yorry be sentenced to 6 years and 8 months in prison plus a fine of Rp. 1 billion, subsidiary to 6 months in prison.

During the reading of the verdict, Yoory followed via a video conference connection because he was self-isolating (isoman) due to exposure to COVID-19.

The verdict is based on the first indictment of Article 2 paragraph (1) of Law Jo. Article 18 No. 31 of 1999 as amended by Law no. 20 of 2001 concerning the Eradication of Corruption Crimes Jo. Article 55 paragraph (1) of the 1st Criminal Code Jo. Article 64 paragraph 1 of the Criminal Code.

According to the Judge, there are things that are aggravating in Yoory's actions.

"The burdensome thing is that the defendant's actions do not support the government's program in eradicating corruption, collusion and nepotism. As the main director of BUMD, the defendant's actions can damage trust in government institutions, in this case the DKI Provincial Government," said Judge Saifuddin.

As for mitigating things, Yoory has never been punished, has family responsibilities, does not enjoy corruption money, and regrets his actions. Yoory was also not charged with a substitute money sentence.

"During the trial process, no evidence was found, in which the defendant Yoory did not enjoy the state losses that were found. However, thus the defendant's actions have enriched the witnesses and PT Adonara Propertindo corporation, where the total amount is Rp. 152.565 billion, so that the element enrich oneself or others or corporations is fulfilled," said the judge.

This case began in the 2018-2020 period, the DKI Jakarta provincial government looked for land for affordable housing for low-income people (MBR) through the "0 Rupiah DP Residential" program.

To realize the program, in 2018 Yoory Corneles as the President Director of Perumda Pembangunan Sarana Jaya (PPSJ), which is a BUMD of the DKI Jakarta Provincial Government, submitted a proposal for Regional Capital Participation (PMD) to the Governor of DKI Jakarta for the 2019 FY APBD of Rp. for the purchase of new production equipment, the "Owning DP 0 Rupiah" project, and the Tanah Abang Primary Center project.

Furthermore, a private company, namely PT Adonara Propertindo, is looking for land according to the criteria requested by Yoory, namely an area of more than 2 hectares, position on a main road, a width of 25 meters in front of a plot of land and a minimum "row" of about 12 meters.

In February 2019, PT Adonara operations manager Anton Adisaputro discovered land in Munjul, Pondok Ranggon, Cipayung, East Jakarta, covering an area of 41,921 square meters belonging to the Congregation of the Sisters of Carolus Boromeus (Congregation of the Sisters of CB).

The "beneficial owners" of PT Adonara, namely Anja Runtuwene and Rudy Hartono Iskandar, agreed that Anja approached the Congregation of Sisters CB and agreed to sell the land in Pondok Ranggon with an area of 41,921 square meters at a price of IDR 2.5 million/sqm.

When a site survey was conducted, it was not possible to determine the boundaries of the land because there was no data or supporting documents for ownership and it was known that the location of the land was on a small road (the road row was not up to 12 meters long) but Yoory still ordered the purchase process to continue.

Yoory then used the services of the Public Appraisal Service Office (KJPP) Wahyono Adi to carry out the appraisal (estimating the price) which was deliberately "backdated" and submitted a report according to Yoory's request, which was Rp. 6.1 million/sqm.

Sarana Jaya then paid the first term of 50 percent to Adonara Propertindo, or Rp. 108.967 billion on April 8, 2019 even though at that time the status of Munjul's land had not yet been transferred from the CB Congregation to Anja. Furthermore, Yoory also agreed to pay the remaining balance of Rp. 43.596 billion on December 18 and 19, 2019 even though he knew that Munjul's land could not be used for the "0 rupiah down payment" project.

Because the deadline for repayment has ended in August 2019 but there has been no realization from Anja Runtuwene, on August 14, 2020, the Congregation of the CB Sisters requested that the Sale and Purchase Binding Agreement (PPJB) be canceled and requested that documents related to property rights be returned and refunded the money. advance of Rp. 10 billion.

The total money received in Anja Runtuwene's account amounted to Rp. 152,565,440,000 and has been used by Anja and Rudy Hartono, among others, for the operational needs of the company PT Adonara Propertindo, transferred to PT RHYS Auto Gallery which is still in the same group as PT Adonara as well as for Anja's personal needs.
