KPK Seeks To Apply Money Laundering Articles In Every Case It Investigates

JAKARTA - The Corruption Eradication Commission (KPK) continues to seek to restore assets from the proceeds of corruption committed by corruptors. One of the ways to do this is by applying the article on money laundering crimes (TPPU) when investigating allegations of corruption.

"This principle is important and the KPK is currently implementing it in every settlement of corruption cases," said Acting Spokesperson for the KPK for Enforcement, Ali Fikri in a written statement, Wednesday, February 23.

Even so, the KPK ensures that the application of the article will not be carried out immediately. Ali said, there are various elements that must be met, such as there has been a change in the form of the proceeds of criminal acts of corruption into assets of economic value such as property, vehicles, securities, and others.

"In practice, the application of the ML article in cases of corruption, of course, must meet various elements," he said.

"However, whether the crime then fulfills the elements to be applied to the ML article or not, the goal remains the same, namely the existence of asset recovery efforts resulting from corruption enjoyed by corruptors," Ali added.

Furthermore, Ali explained that until this year, since 2012, the Corruption Eradication Commission (KPK) has issued 45 ML investigation warrants.

"For information, the KPK is currently investigating a number of money laundering offenses cases, one of the suspects is the inactive Probolinggo Regent Puput Tantriana Sari and her husband, Hasan Aminuddin. Of the two, the KPK is even confiscating assets in the form of land and buildings with a value of up to Rp50 billion.

The determination of Puput and Hasan as suspects for alleged money laundering was carried out after the KPK carried out the development of the bribery case of buying and selling positions that ensnared them.

In the bribery case of buying and selling positions, the KPK has named 22 people as suspects. They consist of 4 bribe recipients and 18 bribe givers.

The bribes given by ASN in the Probolinggo Regency Government are carried out so that they can serve as village head officials. Each person is required to pay Rp. 20 million and the village land tribute of Rp. 5 million per hectare.

The four recipients were Probolinggo Regent Puput Tantriana Sari, DPR member Hasan Aminuddin, Krejengan Sub-district Head Doddy Kurniawan, and Paiton Sub-district Head Muhamad Ridwan.

Meanwhile, 18 donors namely Sumanto, Ali Wafa, Mawardi, Mashudi, Maliha, Mohammad Bambang, Masruhen, Abdul Wafi, Kho'im, Akhmad Saifullah, Jaelani, Uhar, Nurul Hadi, Nuruh Huda, Hasan, Sahir, Sugito, and Syamsuddin as suspects giver.
