Threatened With 15 Years In Prison Charged With Makar Article, 3 Generals Of The Islamic State Of Indonesia In Garut Ask The Judge For This

The three defendants in the treason case underwent their first trial at the Garut District Court, West Java (ANTARA)

GARUT - Three defendants, residents of Pasirwangi Subdistrict, Garut Regency, West Java, who claim to be the Generals of the Indonesian Islamic State (NII) began their first trial at the Garut District Court today. The three are Jajang Koswara, Sodikin, and Ujer.

The defendant attended the trial with a panel of judges chaired by the Head of the Garut District Court, Harris Tewa, with three public prosecutors, one of whom was the head of the Garut District Attorney's Office, Neva Sari Susanti.

Before the trial began, one of the defendants Jajang asked for time to speak to the judge so that he and his two friends were given the fairest punishment.

"Please law us as fairly as possible," said Jajang in the courtroom, as reported by Antara, Thursday, February 17.

The three were charged with treason for carrying a flag and giving speeches related to the NII. The video footage was deliberately distributed to social media.

The head of the Garut District Attorney's Office, Neva Sari Susanti, said the three defendants were charged with Article 107 paragraph 1 in conjunction with Article 55 of the Criminal Code and Article 110 paragraph 5 regarding Makar with a maximum penalty of 15 years in prison.

Neva said the three defendants were also charged with Article 28 paragraph 2 in conjunction with Article 45 paragraph 2 of the ITE Law on Hate Speech with a maximum penalty of six years in prison and a fine of Rp. 1 billion and Article 66 of Law Number 24 of 2009 concerning Insulting the State Emblem.

After the trial of the indictment agenda, the trial of the treason case will be continued on February 24, 2022 with the agenda of presenting witnesses from the prosecutor, then there is the agenda of witnesses from the defendant.

"From us there are 10 witnesses who will be presented, but there could be additional ones, while from the defendants there are two witnesses," said Neva.

Previously, the three defendants were arrested by the Garut Police after a video spread about the treason he committed in Pasirwangi District from 2019 to 2021.
