JAKARTA - Member of Commission I DPR RI from the PKS faction, Al Muzzammil Yusuf, assessed that the period of service between the TNI and Polri should be equalized. This is because the TNI and Polri apparatuses constitutionally have the same main duties and functions (tupoksi).

This was conveyed by Al Muzzammil Yusuf in response to a judicial review to the Constitutional Court (MK) on Article 53 of Law Number 34 of 2004 concerning the TNI. It is known, the lawsuit was filed by 5 people, one of whom is a retired TNI, due to the difference in retirement age settings between members of the TNI and Polri. The general period of service for the National Police is 58 years and can be maximized up to 60 years, while the service period for the TNI is divided into two, namely 53 years for non-commissioned officers and enlisted personnel, and 58 years for officers.

"Referring to Article 28D paragraphs 1, 2, and 3, with similar tupoksi between the defense and security forces, the rules regarding their period of service should be the same," said Al Muzzammil in his statement, Friday, February 11. "Is the Police Law adapting to the TNI or vice versa. I think it is good if it is decided by the Court's judicial review or immediately changes to the related law by the DPR," he continued.

The member of the Legislative Body (Baleg) of the DPR RI does not mind if a lawsuit is filed regarding the tenure of the TNI Commander General Andika Perkasa. If this lawsuit is accepted, said Muzammil, General Andika's term of office has the potential to be extended. Referring to the current TNI Law, General Andika will retire in November 2022.

"If by chance there is a similarity in momentum to the period of General Andika's Service, it doesn't matter. Because if the TNI/Polri Law has been changed proportionally and objectively, all ranks of the TNI and Polri will benefit. Not just General Andika," he said. For information, Article 53 Law 34/2004 concerning the TNI was sued to the Constitutional Court by 5 citizens, one of whom is a retired TNI. The petitioners argue that there is a difference between the retirement age for members of the TNI and the Police.

The retirement period for TNI soldiers is regulated in Law No. 34/2004 concerning the TNI, in Articles 53 and 71 letters a. Article 53 states that soldiers carry out military service until the maximum age of 58 years for officers and 53 years for non-commissioned officers and enlisted men.

Meanwhile, Article 30 paragraph 2 of the National Police Law No. 2/2002 states that the maximum retirement age for members of the Indonesian National Police is 58 years and for members who have special skills and are very much needed in police duties, it can be maintained up to 60 years.
