Reasons Why The Disability Perda In Jakarta Needs To Be Revised

JAKARTA - The DKI Provincial Government and the DKI Jakarta DPRD have begun to draft a revision of Regional Regulation Number 10 of 2011 concerning Protection of Persons with Disabilities. Yesterday, the Draft Regional Regulation on the Implementation of Respect, Protection and Fulfillment of the Rights of Persons with Disabilities was officially submitted to the DKI DPRD for discussion.

Quoted in a speech document explaining the Governor of DKI Jakarta Anies Baswedan regarding the regional regulation on persons with disabilities, there are a number of reasons for the regional government to revise this regulation.

Anies views that Regional Regulation Number 10 of 2011 has not fully used the social model approach in its regulation. Which, it focuses on a multi-sectoral perspective on efforts to respect, protect, and fulfill the rights of persons with disabilities.

"In addition, sociologically, Regional Regulation Number 10 of 2011 concerning the Protection of Persons with Disabilities is no longer relevant. Because many practices of respecting, protecting, and fulfilling the rights of persons with disabilities are based on the initiative of the DKI Jakarta Provincial Government in responding to the immediate needs of persons with disabilities and the community with disabilities in Indonesia. Jakarta's numbers are increasing," said Anies, quoted on Tuesday, February 8.

Then juridically, the revision of the regional regulation on persons with disabilities needs to be adjusted to Law Number 8 of 2016 concerning Persons with Disabilities as a reference for respect, protection, and fulfillment of the rights of persons with disabilities.

"It needs to be done by mainstreaming disability in various sectors by referring to the provisions in Law Number 8 of 2016 concerning Persons with Disabilities," he explained. sports, social welfare, culture and tourism.

Then the aspects of infrastructure, public services, transportation, protection from disasters, habilitation and rehabilitation, data collection, communication and information, concessions, protection of women and children, and protection from acts of discrimination, neglect, torture, and exploitation.

"Through this regional regulation, people with disabilities in the DKI Jakarta area will know what rights they have and oversee the fulfillment of these rights as a form of community participation," he explained.

Furthermore, Anies revealed that there are arrangements for obligations to sanctions imposed on stakeholders to respect, protect, and fulfill the rights of persons with disabilities, which have implications for violations that occur.

"This regulation stipulates that the violations that occur will be subject to administrative sanctions," he added.
