KPK Prosecutor Indicts Acting Head Of PUPRP HSU, Maliki Receives Prize Of IDR 540 Million In Case Of Bribery 2 Projects

PALEMBANG - Prosecutors from the Corruption Eradication Commission (KPK) indicted the Acting Head of the Public Works, Spatial Planning and Land Agency (PUPRP) of Hulu Sungai Utara (HSU) Maliki for accepting a prize of IDR 540 million from two contractors for an irrigation project.

The indictment was read out by KPK Prosecutor Budi Nugraha during the trial for reading the indictment against Maliki at the Banjarmasin Corruption Court, South Kalimantan, as reported by Antara, Wednesday, February 2.

Maliki, who attended the online trial from the Class IIA Lapas Banjarmasin, was charged with allegedly accepting bribes in the form of a 15 percent commitment fee for two projects in the Water Resources Sector, HSU PUPRP Service.

Maliki received the fee commitments from two contractors, namely Marhaini as Director of CV Hanamas and Fachriadi as Director of CV Kalpataru for the work on the Kayakah and Banjang swamp irrigation areas (DIR) projects. It is known that the two private parties were also accused in the same case after the KPK carried out a hand arrest operation (OTT).

In addition, Maliki was also charged with conspiring with the HSU Regent to deactivate Abdul Wahid in the arrangement of the winning bidder.

For his actions, Maliki was charged with Article 12 letter a of Law (UU) Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes Jo. Article 55 paragraph (1) of the 1st Criminal Code Jo. Article 64 paragraph (1) of the Criminal Code.

Then the alternative is Article 11 of Law Number 31 of 1999 concerning Eradication of Corruption Crimes as amended by Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption Crimes Jo. Article 55 paragraph (1) of the 1st Criminal Code Jo. Article 64 paragraph (1) of the Criminal Code.

"The agreement between them at the beginning to win the project had to pay a commitment fee for Abdul Wahid as the regent and Maliki as the Acting Head of PUPRP," explained Nugraha to reporters after the trial.

Meanwhile, the lawyer for the defendant Maliki, Mahyuddin, admitted that he was determined to thoroughly explore who the most important people were in the corruption case that occurred at HSU.

"We will prove in the next trial that our client is only carrying out orders, not intentionally," he said.
