ASN Law Ratified, Confirmed No Layoffs Of Honorary Masses

JAKARTA - Minister of State Apparatus Empowerment and Bureaucratic Reform (Menpan RB) Abdullah Azwar Anas said the Law on Amendments to Law Number 5 of 2014 concerning State Civil Apparatus (UU ASN) became the legal umbrella for the absence of layoffs (PHK) of mass non-ASN (honorary) workers.

"Thanks to the DPR's support, the Law on Amendments to the ASN Law has become a legal umbrella for the implementation of the main principle of non-ASN personnel structuring, namely that there should be no mass layoffs, which President Jokowi has outlined from the start," Anas said as quoted by ANTARA, Tuesday, October 3.

Menpan RB mengatakan penataan tenaga non-ASN yang jumlahnya mencapai lebih dari 2,3 juta orang menjadi salah satu isu krusial dalam pembuatan Draft Undang-Undang (RUU) tentang Perubahan UU Nomor 5 Tahun 2014.

"There are more than 2.3 million non-ASN workers. If they are normative, they will no longer work in November 2023. The ratification of this bill is a law to ensure that everything is safe and continues to work. In other words, we will secure it first so that it can continue to work," he said.

Related to this, Anas said that there would be an expansion of the scheme and work mechanisms of government employees with a work agreement (PPPK) so that it could be an option in the arrangement of honorary staff.

"It will be detailed in government regulations (PP)," he said.

The crucial principle that will be regulated in the PP, he said, one of which is that there should be no decrease in income received by non-ASN personnel at this time due to the arrangement of honorary staff. Moreover, the contribution of non-ASN personnel in government is very significant.

"This is the commitment of the government, the DPR, DPD, regional government associations, and various other stakeholders for non-ASN workers," he said.

In addition, he continued, the government is also designing so that the arrangement does not cause significant additional fiscal burdens for the government.

Anas expressed his gratitude to the DPR, especially Commission II of the DPR, which has provided many meaningful inputs in the preparation of the ASN Bill, including other elements, ranging from the Regional Representative Council (DPD) of the Republic of Indonesia, academics, the Civil Service Corps of the Republic of Indonesia (Korpri), regional government associations, ministries/agencies, non-ASN labor forums, to various other relevant stakeholders who also oversee the ASN Bill.

"Thank you to the DPR and all those who have presented the best thoughts in the preparation of this ASN Bill," he said.

Previously, the 7th Plenary Meeting of the DPR During the First Session of the 2023 Session Year 2024 approved the ratification of the Bill on Amendments to Law Number 5 of 2014 concerning State Civil Apparatus (ASN) into law.

"Can the bill on amendments to Law Number 5 of 2014 concerning State Civil Apparatus be approved to be passed into law?" asked Deputy Speaker of the House of Representatives Sufmi Dasco Ahmad in a plenary meeting.

The question was answered in agreement by all members and representatives of the factions who attended the DPR Plenary Meeting.
