Commission II Of The DPR Is Sure That The KPU Will Win The Appeal Of The Central Jakarta District Court Decision
JAKARTA - Commission II of the DPR believes that the General Election Commission (KPU) of the Republic of Indonesia will win an appeal against the decision of the Central Jakarta District Court (Jakpus) regarding the postponement of the 2024 General Election stage. Deputy Chairman of Commission II of the DPR Junimart Girsang, said that the KPU must file an appeal because the Central Jakarta District Court's decision is wrong. The reason is, the Central Jakarta District Court should not decide on an election case. "According to the absolute competence principle, the KPU's appeal must be granted," said Junimart, Saturday, March 11.
"The appeal legal effort is an obligation for the KPU, including entering a memorandum of appeal containing rational objections to the considerations and decisions of the district court," he continued.
The PDIP legislator said it was easy for the KPU to compile an appeal against the Central Jakarta District Court's decision because the appeal argument only included the authority.
"In my opinion, the KPU argument is very simple in the appeal effort, namely, the district court is not authorized to examine this case. This means that according to the law in the final verdict or decision in the exception, before entering the main case, it must reject this lawsuit," explained Junimart. It is known, the Indonesian KPU officially filed an appeal against the decision of the Central Jakarta District Court (PN Jakpus) which ordered the KPU to stop the 2024 election stage. This appeal refers to the case of the Prima Party's lawsuit which was declared not to have passed the administrative verification stage by the KPU. The Prima Party's lawsuit won at the Central Jakarta District Court.
RI KPU member Mochammad Afifuddin emphasized that this appeal memorandum submission was the KPU's seriousness in addressing legal issues with Prima. As is known, the KPU was also reported to the Election Implementation Honorary Council (DKPP) by KAMMI because it was considered to underestimate Prima's lawsuit at the Central Jakarta District Court. "The Banding statement made by the KPU against the Decision of the Central Jakarta District Court Number 757/Pdt.G/2022/PN.Jkt.Pst is a form of the KPU's seriousness in dealing with and addressing the Lawsuit filed by Prima," Afif told reporters, Friday, March 10. At this time, continued Afif, the KPU is waiting for a decision from the Jakarta High Court Judge against the Appeal submitted.
