Corruption Defendant Of Bagansiapiapi Port Facilities Rokan Hilir Returns Rp983 Million State Money
PeKANBARU - The defendant in the alleged corruption case in the construction of the Bagansiapiapi Port facility, Rokan Hilir Regency, Riau, in 2018, Nathanael Simanjuntak, has returned the remaining state money loss of Rp983 million to the prosecutor's office.Kasi Pidsus Kejari Rokan Hilir Herdianto explained that Nathanael had been sent to prison after being forcibly picked up in Jakarta by the Investigation Team in the Special Crimes Division of the Rokan Hilir District Attorney in October 2022.Nathanael is the Director of PT Multi Karya Pratama who is the provider or implementer of the problematic project activities. During the investigation process, Nathanael once returned part of the money to replace state losses to investigators amounting to Rp500 million.Meanwhile, the findings of state financial losses based on the report of an independent accountant on the audit of the procedures agreed upon and issued by the Public Accountant Office amounted to Rp1,483,335,260.Most recently, through his family representatives, Nathanael returned Rp983 million. The money was handed over at the BRI Bagansiapiapi Office on Monday."We appreciate the good faith of the defendant in returning state losses," said Herdianto through his statement received in Pekanbaru, Antara, Tuesday, March 7.According to Herdianto, with the return, the state's financial losses in the case have recovered because the total amount that has been returned is the same as the findings of the auditor, which is Rp. 1,483,335,260."The trial process of the defendant is still ongoing. However, the refund of state losses made today has been fully carried out," he continued.This good faith from the defendant will later become a consideration for the public prosecutor in bringing down the charges. The same thing will also be considered by the panel of judges in passing their decisions.From the information obtained, the alleged rasuah began in 2018. At that time, the Directorate General of Sea Transportation of the Ministry of Transportation carried out further work activities in the construction of the Bagansiapiapi Sea Port facility, Bangko District, Rokan Hilir.The budget is sourced from the Ministry of Transportation of the Republic of Indonesia cq, Directorate of Sea Transportation in 2018. The project was carried out by PT Multi Karya Pratama (MKP) and supervisory consultant CV Refena Kembar Anugrah (RKA).The project was carried out for 180 days, starting from June 30 to December 31, 2018 with a contract value of IDR 20 billion.At the disbursement stage, conditions such as down payment guarantees, VAT and PPh SSPs, details of the use of down payment, and official progress minutes from consultants are only attached to phase I disbursement. In the phase II-VII disbursement, these conditions were not attached, but the budget was still disbursed.Until the end of the physical contract period on December 31, 2018, the project's work had not reached 100 percent physical weight because some had not yet been completed. For example, the envelope of the HDPE pole has not been installed and the pile for causeway and sheet pile has not been completed.However, payments have been made 100 percent of the contract value and each disbursement process has never attached Asbuild Drawing or image of the implementation and back up of data/final quantity, as well as reports on the progress of work as a basis for determining how much work achievements have been made.Apart from Nathanael, there is M. Tito Rachmat Prasetyo who is a Commitment Making Officer (PPK) who is also a prisoner in the corruption case. Tito has been brought to trial and found guilty.Nathanael and M Tito are strongly suspected of committing an unlawful act which resulted in state financial losses of Rp. 1,483,335,260.Tito was charged by the Prosecutor with imprisonment for 7 years and 6 months and a fine of Rp. 300 million, subsidiary to 6 months in prison. Meanwhile, the compensation for state financial losses was charged to Nathanael Simanjuntak in the amount of Rp. 1,483,335,260.The Panel of Judges at the Corruption Court at the Pekanbaru District Court (PN) has sentenced Tito to 6 years and 6 months in prison and a fine of Rp. 300 million, subsidiary to 4 months in prison.
