Banks Dalih Bharada E Unable To Reject Sambo's Order To Shoot Brigadier J, AGO Compareds To Ricky Rizal

JAKARTA - The Attorney General's Office (Kejagung) assessed that Richard Karya alias Bharada E deserves to be convicted even though in the trial he admitted that he could not refuse orders from his superior Ferdy Sambo to shoot Yosua alias Brigadier J.

"He made the wrong order, so he must be punished," said Deputy Attorney General for General Crimes (Jampidum) at the AGO, Fadil Zumhana, to reporters, Thursday, January 19.

Fadil said carrying out orders to shoot people resulting in death violating the constitution. This action is not protected by law at all.

Fadil also gave an example of the legal shooting before the law, such as the executor for the death penalty. Their actions were justified because they referred to Article 51 of the Criminal Code.

In addition, in a series of murder incidents, Ferdy Sambo actually asked the defendant Ricky Rizal to shoot.

However, Ferdy Sambo's order to shoot Brigadier J was rejected. So, Bharada E should have been able to do the same.

"So my son, he was ordered by Sambo. Who fought whose orders? Ricky Rizal. 'Saya tidak kuat sir, mentalnya nggak kuat', nah bisa. Mere seharusnya bisa menolak, karena tidak ada dalam tugas dan kewenangan dia untuk menumah orang, nggak ada," kata Fadil.

Bharada E is considered proven to have participated in a series of premeditated murder incidents against Yosua alias Brigadier J with his role as the executor. Thus, he was sentenced to imprisonment for 12 years.

"Demanding to impose a sentence on Richard totaling 12 years of reduced detention," said the prosecutor.

In the charge, there were several burdensome considerations. One of them Bharada E is the executor in the premeditated murder case of Brigadier J.

In addition, there are also mitigating considerations. The prosecutor considers Bharada E to be a justice collaborator from the Witness and Victim Protection Agency (LPSK).

"The defendant is the defendant's witness who helped dismantle this case," said the prosecutor.
