Alleged 'Superiors' Orders Behind Bharada E's 12-Year Prison Charges
JAKARTA - The Witness and Victim Protection Agency (LPSK) suspects that the 12-year charge filed by the public prosecutor (JPU) against Richard Eliezer alias Bharada E did not refer to the trial conclusion and considerations.
LPSK Deputy Chairman Edwin Partogi said that there could be directives or orders from the leadership regarding the demands that occurred during the trial.
"Who will be the prosecutor at trial, who will determine the demands can be different matters. Regarding determining the demands, a structural, not functional, mechanism will apply," Edwin told VOI, Thursday, January 19.
The allegations emerged because during the process of reading the charges the prosecutor seemed unable to.
At that time, Attorney Paris Manulu did pause for a few seconds when he was about to read out the indictment. In fact, he had to be strengthened first by his partner next to him.
Attorney Paris was patted on the back several times. Until finally he read out the demands of 12 years in prison for Bharada E.
"Just look at the prosecutor who wants to cry when he reads the final part of his demands," he said.
It's just that, when asked about the 'superior' who was suspected of being the giver of orders as well as determining demands, Edwin was reluctant to say much. He only mentioned that sooner or later the 'superior' would appear.
"Just look who's in action," said Edwin.
Bharada E is considered proven to have participated in a series of premeditated murders against Yosua alias Brigadier J. So, he is charged with imprisonment for 12 years.
"Demanding to impose a sentence against Richard Eliezer for 12 years minus the detention period," said the prosecutor.
In that claim, there are several aggravating considerations. One of them, Bharada E, was the executor in the premeditated murder case of Brigadier J.
In addition, there are also mitigating considerations. The prosecutor considered Bharada E to have the status of a justice collaborator from the Witness and Victim Protection Agency (LPSK).
"The defendant is the defendant's witness who helped uncover this case," said the prosecutor.
Bharada E was charged with shooting Brigadier J with a Glock-17 rifle three to four times. The shooting took place at the official residence of the Police Complex, Duren Tiga, South Jakarta, on 8 July.
Then, before the shooting, Bharada E also participated in the planning. Because he agreed to Ferdy Sambo's order to execute Brigadier J.
