Dear Tiko, Hotman Paris Advises Home Selling So That They Can Live Better Lives
JAKARTA - The well-known lawyer Hotman Paris Hutapea has also responded to Tiko's viral story which has been widely highlighted by the public in recent days. Hotman feels that Tiko is still lucky to get a house inherited from his late father, Herman.
"He (Tiko) is still lucky to be left behind by his parents at a very large house. That his mother is already sick, yes, that's understandable," said Hotman Paris when met in the Pancoran area, South Jakarta on Monday, January 9.
Hotman assessed that Tiko's problems were not too big. He also advised Tiko to sell the house that has now been tidied up.
"My advice, with such a large house, why not sell it. Purchase a smaller house and the rest is used for her mother's happiness and for her daily living expenses. I don't think the problems they face are too serious," he said.
However, Hotman reminded that the problem regarding the house ownership certificate must be resolved first. As is well known, both Tiko and Bu Eny do not hold the house ownership certificate they currently live in.
With Mrs. Eny's current condition of not being able to think normally, Hotman reminded that there are several things that need to be resolved legally. Because, based on existing law, Mrs. Eny as a wife is the first person to have rights to the house after Hendra's death.
"Maybe later in terms of law there will be a problem if the house wants to be sold when the mother is still alive. If you can't normally think anymore, maybe your mother needs a court determination for approval. Because as an heir he (Tiko) and his mother, while his mother needs approval to be able to sell the house," he explained.
Regarding Tiko, his status as the biological child of Hendra and Eny must also be confirmed. I don't know the real fact (the risk of biological child or not). What is clear, that the right to inheritance is the wife and biological child. If it turns out that later there will be no heirs of the biological child or wife, yes, the father. If in Islam the formula is different again, but what is clear is the closest brother," he concluded.
