Criminal Expert Kubu Ferdy Sambo Finds Fault In Bharada E About 'Learning'

JAKARTA - Criminal law experts from the Ferdy Sambo and Putri Candrawarthi camps threw the wrong 'beat' order at Bharada Richard totaling. Bharada E is considered to have misinterpreted the order so that he carried out the shooting that led to the death of Brigadier J.

"According to the legal knowledge that I understand, the applicant cannot be held criminally responsible for the crime, for the actions he does not recommend, cannot," Said said at the trial at the South Jakarta District Court, Tuesday, January 3.

Instead, Said was of the view that Bharada E should be criminally responsible. This is because Ferdy Sambo's former aide has misinterpreted the order.

"So, if, after all, for example, the participants do that he misinterprets or exceeds the recommended limits, then if there are consequences that arise or the legal risks that arise, it is the responsibility of the person as the participant who does it," said Said.

As for the dakwan, Ferdy Sambo ordered Bharada E to shoot Brigadier J. His order read 'Woy, you shoot, you shoot, you shoot fast. Come on, you shoot'.

However, Ferdy Sambo denied the charge. He claims he only ordered Bharada E to beat it.

Ferdy Sambo was charged with violating Article 340 of the Criminal Code, subsidiary to Article 338 of the Criminal Code in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code. They face a maximum sentence of death, life imprisonment or a maximum of 20 years.
