9 Points Of Objection To Nikita Mirzani's Attorney, Dito Mahendra's Losses Considered Legal
JAKARTA - Nikita Mirzani underwent the second trial of the alleged defamation case at the Serang District Court on Monday, November 21. The agenda for the trial itself is the reading of the exception or memorandum of objection from the defendant.
Nikita and her legal team as the defendant read out two different objection notes. One objection note was written by Nikita herself while in detention, while another objection note was made by the legal team.
Fahmi Bachmid, one of the lawyers from Nikita Mirzani's legal team, said that in his exception there were nine points of objection to the indictment submitted by the Public Prosecutor (JPU) at the previous trial.
"Eightty-eight pages of exception. There are nine points," said Fahmi Bachmid after the Serang District Court hearing on Monday, November 21.
Fahmi stated that there were at least two very important points in the exception.
The most important of all the points is, first someone is harmed but report first. He reported on May 16, 2022, the only loss will appear on May 18, 2022. You just use logic, report the police and then the loss will appear two days later. This is the basis for Nikita being detained," he said.
In addition, the lawyer also said that the number and whereabouts of the witnesses referred to by the prosecutor in the indictment were not needed.
"Second, related to the number of witnesses. When talking about social media, Nikita's followers are millions and all are in Jakarta and are everywhere. If you use logic, social media can be done by people in South Jakarta, it can be in Central Jakarta, it can be anywhere. Please don't create witnesses in problems like this, let alone security guards and so on," said Fahmi.
Regarding other points, Fahmi was reluctant to talk about it on the grounds that the points were too technical and involved various articles. He emphasized that the two points are the most important.
Fahmi assessed that the prosecutor's indictment had to be dropped because it was inconsistent. He said that Nikita was confused, because on the one hand his client's uploads in social media were considered defamatory, but on the other hand, he was said to be encouraging.
"We must be canceled in the indictment. The reason is not careful, Nikita is confused. One, Nikita is said to have defamed the article, but she said Nikita appealed," said Nikita Mirzani.
