Wamen Zainut Said That If Someone Was Uncomfortable When He Got A Call, He Could Report To The Police.

Deputy Minister of Religion Zainut Tauhid Sa'adi explained that sexual harassment signals measured by discomfort, demeaning, or harassing could be reported to the police.

"The complaints referred to in this regulation are complaints with nuances of sexual violence, including jokes that have the nuances of seronok and also contain elements of demeaning or harassing objects that disturb the comfort of objects," said Wamne Zainut Tauhid Sa'adi, Thursday, October 20.

Zainut's question is contained in the Regulation of the Minister of Religion (PMA) Number 73 of 2022 concerning the Prevention and Handling of Sexual Violence in the Education Unit at the Ministry of Religion.

The forms of sexual violence regulated in the PMA include verbal, unphysical, physical, and information and communication technology.

He said someone/victim who was uncomfortable because he was harassed could report it to the police with a complaint offense. The offense can only be processed if it is complained by someone who feels disadvantaged or has become a victim.

According to him, Article 18 of PMA regulates sanctions. Paragraph (1) states that perpetrators who are proven to have sexually assaulted based on court decisions that have permanent legal force are subject to criminal sanctions and administrative sanctions.

In paragraph (2) it is stated that the criminal sanction as referred to in paragraph (1) is carried out in accordance with the provisions of the legislation.

"So the application of criminal sanctions based on it is a court decision and a legal mechanism applies as regulated by law," he said.

In this case, the regulation referred to in Law Number 12 of 2022 concerning the Crime of Sexual Violence and or the Criminal Law (KUHP).

The Ministry of Religion has issued a Regulation of the Minister of Religion (PMA) which regulates the Handling and Prevention of Sexual Violence in Education Units that are under its authority.

PMA No. 73 of 2022 was signed by the Minister of Religion Yaqut Cholil Qoumas on October 5, 2022 and began to be promulgated the day after.

The educational units in question include formal, non-formal, and informal education channels, as well as covering madrasas, pesantren, and religious education units.

This PMA consists of a number of chapters, namely general provisions such as forms of sexual violence, prevention, handling, reporting, monitoring, evaluation, sanctions, and closing provisions, a total of 20 articles.

This rule regulates the form of sexual violence including acts committed verbally, unphysically, physically, and/or through information and communication technology. There are at least 16 classifications of forms of sexual violence, including conveying speech that discriminates against or insults the physical appearance, body condition, or gender identity of victims.
