The Police Who Shot Halu Student Oleo Kendari La Randy Was Sentenced To 4 Years In Prison

JAKARTA - The Panel of Judges at the South Jakarta District Court has sentenced Brigadier Abdul Malik (AM) to the convicted shooter of La Randy, a student at the University of Halu Oleo Kendari, Southeast Sulawesi.

The verdict was read by the Chief Justice of the Panel of Judges, Agus Widodo, during the trial to read out the charges which took place by teleconference at the South Jakarta District Court and the Southeast Sulawesi District Prosecutor's Office and the Police Headquarters Detention Center.

"Tried and declared that the defendant Abdul Malik was legally and convincingly proven to have committed a criminal act because his negligence resulted in death, because his negligence caused other people to be injured," said Judge Agus Widodo, quoted by Antara, Tuesday, December 1.

The panel of judges sentenced the defendant to four years in prison and ordered the defendant to remain detained in the state-owned detention center.

The judge also determined that the period of detention the defendant had served was not included in the sentence that had been imposed.

The decision of the Panel of Judges at the South Jakarta District Court is in accordance with the indictment of the Public Prosecutor (JPU) who demanded the defendant four years in prison because his actions violated Article 359 and Article 360 paragraph (2) of the Criminal Code, namely because his negligence caused another person to die (Article 359) and because his negligence causes others to be injured (Article 360).

In its decision, the Panel of Judges considered matters incriminating the defendant, namely that the defendant's actions had tarnished the police institution and the defendant's actions had caused unrest in the community.

"The lightening thing is that the defendant has never been convicted, has a family and has a wife and a child and the defendant is responsible for helping the victim's treatment," said Judge Agus.

After the verdict was read out, both the defendant and his attorney and the prosecutor who were present online stated that they would think about it for seven days before accepting the verdict of the Panel of Judges.

Randy is a student of the Department of Aquaculture, Faculty of Fisheries and Marine Sciences (FPIK), Halu Oleo University (UHO) class of 2016 who was shot dead during a demonstration against the revision of the KPK Law at the Southeast Sulawesi Provincial DPRD Office on September 26, 2019.

Randy was allegedly shot dead by the suspect Brigadier AM. Apart from Randy. The Polda is also conducting an investigation into the death of another student, namely Muhammad Yusuf Kardawi (19) D-3 Civil Engineering Department, Vocational Education Program (PPV) batch 2018.

Apart from Randy, the perpetrator's actions also resulted in a pregnant woman being injured during a demonstration against the Criminal Code Bill and the 2019 KPK Law.

In the facts of the trial, it was revealed that the defendant AM did not attend the demonstration security guard, so he did not listen to the leadership's direction that in handling demonstrations it is not permissible to use firearms.
