ELSAM Values Of PDP Law Follow International Standards, Data Protection Authority Must Be The Key To Success
Jakarta - Executive Director of the Institute for Community Studies and Advocacy (ELSAM) Wahyudi Djafar said the Personal Data Protection Bill (RUU PDP) agreed by the DPR had followed the standards and principles of general personal data protection that apply internationally.“ In general, reading the material substance of the PDP Law that was agreed to have followed the general standards and principles of protecting personal data that apply internationally, ” Wahyudi said when confirmed by ANTARA from Jakarta, Tuesday, September 20.Especially, said Wahyudi, there is clarity on the definition of personal data, the reach of materials that apply binding to public bodies and the private sector, special protection for specific data, adoption of the principles of personal data processing, basic limits on the legal process of personal data, protection of the rights of data subjects, and the obligation to control and process data.<quo;Artinya dengan klausul tersebut, seharusnya legislasi ini dapat memberikan kepastian hukum dan perlindungan hukum yang menyeluruh dalam pemrosesan data pribadi di Indonesia,” ucap Wahyudi.Wahyudi reminded that the key to the effectiveness of implementing the PDP Law rests with the data protection authority, as a supervisory agency, which will ensure compliance with data controllers and processors, and ensure the fulfillment of the rights of data subjects.Especially when the PDP Law is binding not only for the private sector, but also for public bodies (ministries/agencies), the independence of this authority is absolute to ensure firmness and justice in the enforcement of PDP law.Furthermore, the big challenge of implementing the PDP Law is the preparation and formation of various implementing regulations, ranging from Government Regulations, Presidential Regulations, institutional regulations, to various other technical guidelines.“ With such challenges, in addition to the political leadership of the President given the mandate to implement this law, a role and good faith of all stakeholders is also needed to be able to improve the governance of the personal data protection ecosystem in Indonesia,” Wahyudi said.
