Former KSAU Agus Supriyatna Bantah Mangkir, Lawyer: KPK Call To Fight The Law

JAKARTA - Former Air Force Chief of Staff (KSAU) Agus Supriyatna will be present to fulfill the summons of the Corruption Eradication Commission (KPK). Provided that the summons is carried out according to the applicable mechanism.

This was conveyed by his lawyer, Pahrozi. He said there was a mechanism that the KPK had to fulfill so that his client was present as a witness to the alleged corruption in the procurement of the AW-101 Helicopter.

"We will attend throughout the summons according to the applicable law and mechanism," Pahrizi told VOI, Tuesday, September 13.

Furthermore, Paharozi denied that his client was absent from witness summons some time ago. He said Agus was not present at that time because the summons from the anti-corruption commission was against the law and the applicable legislation.

In addition, Paharozi said that his party had sent a letter to the KPK regarding Agus' absence. "It's not true that our client is not cooperative," he said.

"What is true is that the KPK summons against the witness is against the applicable laws and invitations. So that our client cannot fulfill the summons and on the day our summons has written to the KPK and communicated with the cassation of this case," explained Paharozi.

Previously, the KPK confirmed that it would summon former KSAU Agus Supriyatna. Head of the KPK News Division Ali Fikri said the summons would begin with sending a letter.

"We will immediately send a second summons for the witness in question," Ali said in a written statement to reporters, Monday, September 12.

Ali asked the witnesses who were summoned by the KPK to cooperate, including Agus Supriatna. If he really can't explain his knowledge regarding the procurement of the AW-101 Helicopter because it is bound by the rules, this can be conveyed to investigators.

"We hope that cooperative witnesses will be present to fulfill the summons of the KPK as a form of obedience to the law," he said.

"Please explain later in front of the investigative team if you feel you cannot be examined or not in accordance with the provisions of the law," continued Ali.

As for this case, the Director of PT Diratama Jaya Mandiri Irfan Kurnia Saleh or John Irfan Kenway is a suspect in the alleged bribery in the procurement of the AW-101 helicopter. He was detained at the KPK Detention Center at the KPK's Merah Putih building.

The KPK suspects that Irfan as a private party is actively holding meetings with the Indonesian Air Force and committing a number of frauds.

Among other things, receiving a payment of 100 percent of the contract value. In fact, there are several types of work that do not match specifications such as not installing cargo doors and the number of seats on helicopters that are not appropriate.

For his actions, Irfan is suspected of violating Article 2 paragraph 1 or Article 3 of the Corruption Eradication Law (UU Tipikor) in conjunction with Article 55 paragraph 1 of the Criminal Code.
