Mediation Room Built On Jalan Tera, Kejari Bandung Will Use It To Process Cases With Restorative Justice
BANDUNG - The Bandung City Government (Pemkot) has built a building in the form of a mediation room for handling legal problems which could have been resolved through restorative justice.
Bandung Mayor Yana Mulyana said that the space could be used by the Bandung City Attorney's Office (Kejari) which processes legal cases without having to go to court.
The mediation room facility provided to the Bandung City Kejari is located on Jalan Tera, Bandung City, West Java.
The facility, said Yana, will be used in accordance with the duration required by the prosecutor's office in resolving legal cases through mediation.
With restorative justice, he hopes the number of convicts can be reduced. In addition, according to him, both parties who are experiencing legal problems can solve the problem with local wisdom.
"In the city of Bandung, we are someah (friendly) to each other. Insha Allah everything can be resolved by friendship through mediation," Yana said in Bandung, West Java, quoted from Antara, Tuesday, August 9.
Meanwhile, the Head of the Bandung City Attorney General's Office, Rachmad Vidianto, said that with the application of restorative justice, the community could participate in the mediation process from beginning to end if there was a case that was not transferred to the court.
"So we can know why, so that people can follow," said Rachmad.
Even so, according to him, not all cases can be resolved with the application of restorative justice. There are several legal requirements which, according to him, can be resolved with restorative justice, including that the perpetrator has committed a crime for the first time, and the loss does not exceed Rp. 2.5 million.
"Usually after the case is investigated by the police, we will read the case file, from there we can judge. If the case is small, we can ask the victim, it is really heartbreaking to imprison him like this," he said.
From his experience so far, according to him, five cases have been resolved at the mediation table. According to Rachmad, the victims usually don't have the heart to punish the perpetrators and only want to provide a deterrent effect.
"Sometimes people who steal, for example, steal fried bananas, it's not necessarily evil, but it could be because he is hungry and there is no money to buy it," he said.
