LBH Medan Complains North Sumatra Police To The Information Commission
MEDAN - The North Sumatran Police filed a complaint with the Medan Legal Aid Institute (LBH) to the North Sumatra Information Commission (KI) through a public information dispute resolution request.
The complaint is contained in a letter numbered 178/LBH/S/VII/2022, dated July 26, 2022.
The complaint was submitted by LBH Medan because the North Sumatra Police did not disclose the DPO data even though the application had been submitted.
The Deputy Director of LBH Medan, Irvan Saputra, explained that the request for the data submitted began when his party opened the DPO post which allegedly had not been arrested since December 1, 2021.
"Due to the existence of the post, LBH Medan has a lot of data on DPOs who allegedly have not been arrested in the jurisdiction of North Sumatra. This is the responsibility of the Regional Police of North Sumatra," said Irvan, Thursday, July 28.
From the data it has, LBH Medan noted that there were 62 people who became DPOs. In detail, 3 people became DPOs at the North Sumatra Police.
Then, Medan Polrestabes 1 person, Coal Resort Police 25 people, Asahan Police 19 people. In addition, 2 people from Deli Serdang Police, 1 Percut Sei Tuan Police, 1 East Medan Police, 9 Sunggal Police and 1 Patumbak Police.
"Before the application for the settlement of this public information dispute was submitted, LBH Medan has officially sent a letter to the North Sumatra Police Chief and his staff on April 8, 2022 with the letter number: 91/LBH/S/IV/2022, regarding requesting data for a list of people looking for. did not get any reply or response," explained Irvan.
To avoid negative public perspectives, LBH Medan again sent a letter on June 23, 2022 with letter number: 148/LBH/S/VI/2022 regarding objections and requesting DPO data. But back again did not get a reply or inform why no reply.
"Therefore, through the request for dispute resolution of information, LBH Medan asked the North Sumatra Regional Information Commission to immediately follow up on the a quo request while carrying out a fair settlement of public information disputes," he said.
LBH Medan suspects that the North Sumatran Police's failure to provide DPO data, which is public data, has violated Article 1 Paragraph (3), Article 27 Paragraph (1), Article 28 D Paragraph (1) of the 1945 Constitution of the Republic of Indonesia in conjunction with Article 5 Law 39 of 1999.
Then, Article 17 in conjunction with 21 of the Criminal Code of the Republic of Indonesia Law Number 14 of 2008 concerning Public Information Disclosure in conjunction with Information Commission Regulation of the Republic of Indonesia Number 1 of 2021 concerning Public Information Service Standards concerning Public Information Disclosure. And Article 7 of the Perkap Number: 14 of 2011 concerning the Code of Ethics of the Indonesian National Police and Article 7 of the Universal Declaration of Human Rights.
