Anies Finally Appeals To The Administrative Court Decision On DKI UMP, PDIP: Problems Become Prolonged
JAKARTA - DKI Jakarta Governor Anies Basedan finally decided to appeal the decision of the Jakarta State Administrative Court (PTUN) which lowered the DKI provincial minimum wage (UMP) in 2022.
Member of Commission B of the DKI Jakarta DPRD from the PDIP Faction, Gilbert Simanjuntak, regretted this. Although it is Anies' right to appeal, Gilbert views this will add new problems.
Given, Anies' decision to increase the UMP by 5.1 percent to Rp. 4.6 million per month violates the provisions of the Ministry of Manpower (Kemenaker).
"The problem actually arose because the Governor issued a decree to increase wages above the Decree of the Minister of Manpower. After being sued by the entrepreneur and the PTUN won, now the issue has become prolonged with an appeal," Gilbert said when contacted, Thursday, July 28.
Gilbert also views the appeal decision as unwise because there is no new evidence to be submitted. Then, Anies' attitude against the PTUN decision seemed political because it was limited to fulfilling the request of one party.
"Managing Jakarta requires people who are wise to see the problem from various angles, not just populist but burdensome to many parties amid the many businesses that have collapsed due to the pandemic," he said.
Previously, the Governor of DKI Jakarta Anies Basedan finally decided to appeal the decision of the Jakarta State Administrative Court (PTUN) which ordered the reduction of the DKI Jakarta provincial minimum wage (UMP) in 2022 from Rp. 4.6 million to Rp. 4.5 million.
This PTUN decision previously canceled the Governor's Decree (Kepgub) Number 1517 of 2021 concerning the 2022 Provincial Minimum Wage.
The head of the DKI Jakarta Legal Bureau, Yayan Yuhana, said that the appeal was an effort by the DKI Provincial Government to maintain the 5.1 percent UMP increase previously set by Anies.
"We hope that with this appeal, the UMP amount of Rp.4,641,852 according to the Governor's Decree Number 1517 of 2021 will not be canceled," said Yayan, Wednesday, July 27.
Yayan admitted that the DKI Provincial Government appreciated the decision of the panel of judges on the UMP decision in terms of justifying the authority of the DKI Jakarta Governor in making UMP policies and confirming the right of workers to get a living wage.
However, after comprehensively reviewing and studying the decision of the Panel of Judges, it is still not in line with the expectations of the DKI Provincial Government.
In which, in his policy of increasing the UMP, Anies considered a decent standard of living for workers and rising inflation.
"The UMP value set in the Gubernatorial Decree has taken into account the inflation rate, as well as the feasibility and welfare of workers' lives," said Yayan.
