Pocketing Evidence And Working According To The Rules, KPK Asks Judges To Reject Mardani Maming's Pretrial

JAKARTA - The Corruption Eradication Commission (KPK) asked the South Jakarta District Court (PN) panel of judges to reject the pretrial proposed by the former Tanah Bumbu Regent, South Kalimantan, Mardani H. Maming. The investigation into the alleged corruption of bribery and gratuities is confirmed to be in accordance with the applicable law.

"Rejecting the Pretrial application submitted by the Petitioner as registered in the case register Number 55/Pid.Pra/2022/PN Jkt.Sel. or at least stating that the Pretrial application cannot be accepted," as quoted from the request by the KPK legal team which was read out at the South Jakarta District Court, Wednesday. , July 20.

The KPK ensures that the investigation and investigation process in this case is in accordance with applicable procedures. The investigation into the alleged corruption began with public complaints which were then followed up.

"After sufficient preliminary evidence is found by the investigator, based on the provisions of Article 44 paragraph (2) of the KPK Law, the investigator exposes/declares the case before the leadership to be raised to the investigation stage and establishes the Petitioner as the suspect."

"Such a process is a series of criminal procedural legal processes that function to enforce material criminal law, especially corruption cases handled by the KPK."

In investigating the alleged bribery and gratification, the KPK also ensures that it has sufficient evidence regarding the alleged bribery and gratification that was allegedly carried out by Mardani.

"The Respondent has had sufficient and valid preliminary evidence to determine the Petitioner (MM) as a suspect."

With these various conditions, the panel of judges was asked to declare that Mardani's determination as a suspect was valid and had binding legal force.

"Declaring that the Respondent has the authority to investigate corruption crimes. Stating that the investigation carried out by the Respondent is valid according to law and has binding force."

Previously reported, Mardani filed a pretrial lawsuit to the South Jakarta District Court after receiving a letter of naming the suspect from the KPK. The Executive Board of Nahdlatul Ulama (PBNU) appointed members of the Governor's Team for the Acceleration of Development (TGUPP) DKI Jakarta Bambang Widjojanto and former Deputy Minister of Law and Human Rights (Wamenkumham) Denny Indrayana as legal counsel.

The chairman of the Indonesian Young Entrepreneurs Association (HIPMI) has been named a suspect in alleged bribery and gratification related to mining permits in Tanah Bumbu, Kalimantan. This corrupt practice allegedly occurred when Mardani was still in office.

The determination of Maming as a suspect by the KPK was initially known from the Directorate General of Immigration when confirming the existence of prevention abroad. Meanwhile, the KPK has not made an announcement because efforts to force detention have not been carried out.
