Prosecutors Appeal Sentences Of 4 Corruption Convicts Of PDPDE And Sriwijaya Mosque, Including Alex Noerdin
PALEMBANG - The Public Prosecutor of the South Sumatra High Prosecutor's Office appealed the verdicts for four defendants related to cases of alleged criminal acts of corruption, the purchase of natural gas by BUMD Regional Mining and Energy Companies (PDPDE) in 2010-2019, as well as grant funds for the construction of the Sriwijaya Mosque in Palembang .
"That in the case of the four defendants, the High Prosecutor's Office through the Palembang District Prosecutor's Office has declared an appeal on Tuesday, June 21, 2022," said Head of the Legal Information Section of the South Sumatra High Prosecutor's Office, Mohd Radyan in Palembang, as quoted by Antara, Wednesday, June 22.
According to him, the prosecutor declared an appeal against all cases set by the panel of judges against the four defendants.
The four defendants, Alex Noerdin and Muddai Madang, were sentenced to 12 years in prison. Furthermore, the defendants Caca Isa Saleh Sadikin and A Yaniarsyah Hasan who were sentenced to 11 years in prison by the Panel of Judges of the Palembang Corruption Crime District Court (Tipikor), chaired by Judge Yoserizal, on Wednesday (15/6) and Thursday (16/6).
"After stating the appeal, the prosecutor will submit the memorandum of appeal, and will also make a counter memorandum of appeal if the defendant submits the memorandum of appeal," added Radyan.
Previously, the defendants Alex Noerdin and Muddai Madang were sentenced to 12 years in prison in cases of alleged criminal acts of corruption, the purchase of natural gas by the Regional Mining and Energy Enterprises (PDPDE) in 2010-2019 and grant funds for the construction of the Palembang Sriwijaya Mosque.
In the verdict of the defendant Alex Noerdin, the panel of judges sentenced him to 12 years in prison as well as a fine of Rp. 1 billion, subsidiary to 6 months in prison, and ordered that all the confiscated assets of the former Governor of South Sumatra be returned.
The return of the property was ordered because the Panel of Judges did not find evidence that the defendant received the flow of funds as demanded by the Public Prosecutor for the two cases that ensnared him in the trial.
The verdict of the Panel of Judges differs from the demands of the Public Prosecutor, which demands that the defendant Alex Noerdin be sentenced to 20 years in prison and also requires to pay compensation of US$3.2 million for the PDPDE case and Rp.
Furthermore, for the defendant Muddai Madang, the former director of PT Dika Karya Lintas Nusa (PT DKLN) was proven in the South Sumatra PDPDE and Money Laundering (TPPU) cases so that the Panel of Judges sentenced him to 12 years in prison and was sentenced to pay compensation of IDR 36 billion.
Then the defendant Muddai Madang was found not guilty in the case of alleged corruption in the grant funds for the construction of the Sriwijaya Palembang Grand Mosque in his capacity as the former Treasurer of the Sriwijaya Mosque Waqf Foundation.
The verdict of the Panel of Judges against Muddai Madang is different from the demands of the Public Prosecutor, which demands that the defendant Mudai Maddang be sentenced to 20 years in prison and also requires to pay compensation of 17 million US dollars and Rp. 2.1 billion in the case that ensnared him.
As for the defendant A Yaniarsyah Hasan, former Director of PDPDE and concurrently as former Director of PT DKLN and Director of PT. PDPDE Gas (a joint venture), the defendant Caca Ica Saleh S, the former President Director of PDPDE and concurrently the President Director of PT PDPDE Gas, was sentenced to 11 years in prison in the South Sumatra PDPDE case and money laundering.
The two defendants were sentenced by the Panel of Judges to pay replacement money, namely Rp. 10 billion for A Yaniarsyah Hasan and Rp. 4.5 billion for Caca Isa Saleh S.
The verdicts against the two defendants are also different from the demands of the Public Prosecutor, namely that they are sentenced to 18 years in prison and also require to pay compensation of 5 million US dollars for A Yaniarsyah and 3.5 million US dollars for the defendant Caca Isa Saleh.
