JAKARTA - OpenAI officially urged legal authorities in the states of California and Delaware to investigate alleged anti-competitive behavior by Elon Musk and his partners, amid the heating up of a legal conflict between two major forces in the artificial intelligence industry.

The move comes just weeks before a trial between the two parties is scheduled to begin in April 2026, in a case that has the potential to become one of the most impactful disputes in the history of the AI industry.

In a letter sent to California Attorney General Rob Bonta and Delaware Attorney General Kathy Jennings, OpenAI assessed that the lawsuit filed by Musk contained elements of "unacceptable and anti-competitive behavior".

The conflict stems from Musk's 2024 lawsuit against OpenAI and its CEO Sam Altman, who accused the company of deviating from its original mission as a non-profit organization by transforming into a profit-oriented entity.

Musk, who co-founded OpenAI in 2015 before leaving in 2018, now leads a rival AI company through xAI with its flagship chatbot Grok.

In an earlier court document, OpenAI also revealed that Musk had tried to join Mark Zuckerberg in joining a consortium that sought to take over OpenAI, although the attempt was unsuccessful.

OpenAI highlighted the value of the lawsuit filed by Musk, which it said amounted to more than 100 billion US dollars against their non-profit foundation. The company assessed that the lawsuit had the potential to "effectively cripple the organization".

OpenAI's chief strategist, Jason Kwon, in his letter confirmed that the lawsuit could hinder the company's efforts to ensure that the development of artificial general intelligence (AGI) continues to provide broad benefits to humanity.

"This lawsuit risks undermining our efforts to ensure that AGI benefits all of humanity," Kwon wrote.

He also criticized the regulatory authorities, who were judged not to have conducted a thorough investigation into OpenAI's restructuring plan. "The documents submitted by Musk show that your office may not have conducted an in-depth investigation and only relied on promises regarding OpenAI's future steps," he added.

Meanwhile, a court in Oakland, California, in January 2026 had ruled that the case would be tried before a jury, with the trial scheduled to begin this month.
