JAKARTA - The State Administrative Court (PTUN) granted the lawsuit of former General Election Commission Commissioner Evi Novida Ginting regarding his dismissal. PTUN obliged the defendant to return Evi's position as Commissioner of the KPU.

The defendant in this case is President Joko Widodo as the party who fired Evi. In the Decree of President Joko Widodo Number 34 / P of 2020, Jokowi officially dismissed Evi with disrespect on 23 March.

"Require the defendant to rehabilitate the good name and restore the position of the Plaintiff as a Member of the General Election Commission for the 2017-2022 term before being dismissed," read a copy of the decision.

In the PTUN decision number 82 / G / 2020 / PTUN.JKT which came out today, the PTUN panel of judges fully granted Evi's claim.

PTUN also requires President Jokowi to revoke Decree Number 34 / P of 2020 concerning the Disrespectful Dismissal of Members of the General Election Commission for the 2017-2022 term of office on behalf of Dra. Evi Novida Ginting Manik.

Responding to this, Evi's attorney, Heru Widodo, hopes that Jokowi will carry out the PTUN decision and not file an appeal to the State Administrative High Court (PTTUN).

"We hope that the President is wise in taking the next step and is no different from the attitude when the PTUN granted PMH's lawsuit against internet restrictions in Papua, he did not file an appeal," Heru said when contacted.

As is known, on March 23, Jokowi dishonorably fired Evi from the position of Commissioner of the KPU. This decision is based on the decision of the Honorary Council of Election Administrators (DKPP).

On March 18, DKPP dismissed Indonesian KPU Commissioner Evi Novida Ginting Manik because he was considered to have intervened in the vote acquisition and determination of the Elected Candidate for Members of the West Kalimantan Provincial DPRD VI.

Evi was fired because he held the position of commissioner in technical affairs and who should be responsible for this problem. Meanwhile, the Chairman of the KPU and other commissioners received the final harsh warning sanctions.

Evi did not stay silent. He challenged this decision to the State Administrative Court (PTUN). Evi thought that there was something wrong with the DKPP decision (the basis for Jokowi's dismissal) which considered the KPU to violate the code of ethics.
