JAKARTA - President Joko Widodo (Jokowi) has revised the regulations for the Pre-Work Card program. One of the points of change is the rule that requires participants to return the assistance or incentives received, if they do not meet the requirements.

Not only that, the management of the pre-employment cards was also given the authority to file criminal charges against those who falsified personal data to become program participants.

This new rule is contained in Presidential Decree 76 of 2020 concerning Amendments to Presidential Regulation Number 36 of 2020 concerning Work Competency Development through the Pre-Employment Card Program. This regulation was signed by Jokowi on July 7, 2020.

In the regulation received by VOI, Saturday, July 11, it was explained that pre-employment card participants who do not meet the requirements, because they have falsified data and have received assistance or incentives, are obliged to return it to the state. This new rule is contained in Article 31C paragraph (1) which reads:

"Recipients of Pre-Employment Cards who do not meet the requirements as referred to in Article 3 paragraph (2), paragraph (3), paragraph (4), and paragraph (5) and have received training fee assistance as referred to in Article 5 paragraph (1) and / or Incentives as referred to in Article 8 are required to return the assistance for the said training and / or incentive costs to the state. "

In paragraph (2) of the regulation, participants are also required to return training fees within a period of not more than 60 days. If not returned, the executing management will sue for compensation.

Then, the management of the pre-employment card implementation can file criminal charges combined with claims for compensation against participants who are proven to have falsified data. This is regulated in Article 31D which reads:

"In the event that the Pre-Employment Card recipient deliberately falsifies his identity or personal data, the Executing Management submits a criminal charge which can be combined with a claim for compensation in accordance with the provisions of the legislation."

Based on the regulation, the Pre-Employment Card is defined as a competency development program in the form of financial assistance aimed at job seekers, workers affected by layoffs or workers who need increased competence.

Participants who take part in this program will receive a training fee incentive of IDR 1 million. Then participants also receive an incentive of Rp. 600 thousand for four months, and a survey incentive of Rp. 50 thousand for three months.

For your information, to date, three batches of the Pre-Work Card program have been implemented with a total of 11.2 million applicants from 513 districts and cities throughout Indonesia, and 680,918 participants have been selected.

To adjust to the President's direction to prioritize those whose livelihoods are affected by the COVID-19 pandemic, the composition of the participants is as follows: 392,338 workers affected by layoffs (PHK) or 58 percent; job seekers 244,531 or 35 percent; MSME actors were 7,396 or 1 percent and workers who were still working or being sent home were 36,653 or 6 percent.
