President Jokowi Signs PP On Discipline For Civil Servants Must Report Wealth, If Not Penalized

JAKARTA - President Joko Widodo has issued Government Regulation (PP) Number 94 of 2021 concerning Discipline for Civil Servants (PNS).

The PP was issued to implement the provisions of Article 86 Paragraph (4) of Law Number 5 of 2014 concerning State Civil Apparatus related to civil servant discipline.

As stated in a copy of the PP, Article 4 Letter e PP states the obligation of civil servants to report assets.

Civil servants who fail to report assets may be subject to moderate to severe disciplinary penalties.

Launching Antara, Tuesday, September 14, in Article 10 Paragraph (2) Letter e it is explained that disciplinary penalties are being applied to civil servants who do not meet the provisions for reporting assets to officials who

authorized in accordance with the provisions of the legislation as referred to in Article 4 Letter e, which is carried out by administrator officials and functional officials.

Article 11 Paragraph (2) Letter c states that severe disciplinary penalties are imposed for violations of the obligation to report assets to authorized officials in accordance with the provisions of the legislation as referred to in Article 4 Letter e, which are carried out by high-ranking officials and other officials.

Types of moderate disciplinary punishment consist of:

a. Deduction of performance allowance by 25 percent for 6 (six) months;

b. Deduction of performance allowance by 25 percent for 9 (nine) months; or

c. Deduction of performance allowance by 25 percent for 12 (twelve) months.

Types of severe disciplinary punishment:

a. Demotion to a lower level for 12 months;

b. Exemption from his position to become executive for 12 months; and

c. Dismissal with respect is not at his own request as a civil servant.

This PP was enacted by President Joko Widodo in Jakarta on August 31, 2021 and promulgated by the Minister of Law and Human Rights Yasonna Laoly on the same date.
