Legal Expert: Based On The MA's Decision, KPK Cannot Dismiss 75 Officers Who Did Not Pass TWK

JAKARTA - Al-Azhar Indonesia University (UAI) legal expert Suparji Ahmad said the leadership of the Corruption Eradication Commission (KPK) could not dismiss 75 KPK employees who did not pass the national insight test (TWK).

This was stated by Suparji based on the decision of the Supreme Court (MA) the results of the assessment of the national insight test (TWK) for employees of the Corruption Eradication Commission (KPK) became the authority of the government.

"No, it must be noted that the Supreme Court's decision should be followed up by paying attention to the continuity of the fate of the employee," said Suparji, Tuesday, September 14.

Suparji continued that as long as the government, in this case President Joko Widodo, does not make any decisions, the KPK leadership should also do the same.

He advised the KPK leadership to wait for a firm stance from the government regarding the fate of the 75 KPK employees.

"There is no decision yet, we have to wait for the government's attitude," said Suparji.

It is known that in the Supreme Court's decision, the decision to follow up on the results of the national insight test (TWK) for employees of the Corruption Eradication Commission (KPK) is the authority of the government.

This is stated in the decision on the judicial review of Commission Regulation (Perkom) Number 1 of 2021 concerning the Transfer of KPK employees to State Civil Apparatus (ASN) which was submitted by KPK employees some time ago.

According to the Supreme Court's decision, the lawsuit against Commission Regulation Number 1 of 2021 which is the basis for TWK is not appropriate. This is because the results of the TWK assessment are not the authority of the KPK, but the government.
