Judge Rejects Exceptions For Two Defendants Of Corn Seed Corruption

MATARAM - The judges of the Mataram Corruption District Court rejected all exceptions or memorandums of objection to the two defendants of corruption in the 2017 Balitbang Hybrid Corn Seed Procurement at the Department of Agriculture and Plantation (Distanbun) of NTB.

"The panel of judges declares that the objections of the defendant and the defendant's legal counsel are groundless and unacceptable," said Chief Justice I Ketut Somanasa reading the interlocutory verdict for the first trial with the defendant Aryanto Prametu, at the Mataram Tipikor District Court, reported by Antara, Tuesday, 14 September.

With such a statement, the panel of judges ordered that the trial continue to the stage of proving the case in accordance with the indictment of the public prosecutor (JPU).

"Ordered the public prosecutor to prepare witnesses who will be presented in the agenda of proving the case," he said.

The evidence, which continues on the agenda for examining witnesses, was mutually agreed to be held on Tuesday (28/9).

The defendants Aryanto Prametu and Lalu Ikhwanul Hubby were directors of the goods supply company in the 2017 Balitbang Hybrid Corn Seed Procurement Project.

Aryanto Prametu's company, namely PT Sinta Agro Mandiri (SAM) received the distribution in the first phase with a budget of Rp. 17,256 billion. Then for the second phase worth Rp. 31 billion by the company owned by Lalu Ikhwanul Hubby, PT Wahana Banu Sejahtera (WBS).

From the total budget, the number of state losses calculated by the NTB Representative BPKP reached Rp. 27.35 billion by calculation, PT SAM was worth Rp. 15.43 billion and PT WBS, Rp. 11.92 billion.

The emergence of these losses is based on the total population of the country's loss audit expert team. The disadvantages are inferred from the existence of wrong or fake certificates, duplicates and uncertified ones. Then there are also certificates that are not in accordance with the order for disbursement of funds (SP2D).

So that in the indictment, the two defendants were charged with the same article, namely Article 2 Paragraph 1 Juncto Article 18 of the Law on the Eradication of Criminal Acts of Corruption in conjunction with Article 55 Paragraph 1 of the Criminal Code and/or Article 3 in conjunction with Article 18 of the Law on the Eradication of Criminal Acts. Corruption in conjunction with Article 55 Paragraph 1 of the 1st Criminal Code.

The project for the procurement of corn seeds for the 2017 fiscal year comes from the national-scale corn cultivation program of the Directorate General of Food Crops, Ministry of Agriculture of the Republic of Indonesia.

At that time, the province of NTB received a planting quota of 400,805 hectares with a harvest target of 380,765 hectares. The procurement is spread across all regencies/cities in NTB with a budget of IDR 48.256 billion of the total national scale procurement of IDR 170 billion.
