In Line With Luhut, Junimart Girsang: If I Ignore The Emergency PPKM, The Regional Head Must Be Dismissed

JAKARTA - Deputy Chairman of Commission II of the DPR, Junimart Girsang, confirmed the existence of sanctions for regional heads who are proven not to have implemented the implementation of the Emergency Community Activity Restriction (PPKM). The sanctions, called Junimart, can reach the level of dismissal of the regional head.

"If it is proven that they have neglected the emergency PPKM which has resulted in the loss of people's health, the regional head must be dismissed," Junimart told reporters, Friday, July 2.

The dismissal, he continued, could be carried out in accordance with the provisions of Law 23/2014 concerning Regional Government (Pemda).

"It can be dismissed if it violates the Regional Government Law through a mechanism that has been regulated and through the decision of the Supreme Court (MA)," said Junimart.

However, Junimart emphasized that regional heads are obliged to save the health of their citizens even without or with central government policies. Therefore, he said, regional heads who ignore the provisions of the law must be severely punished.

"It is the responsibility of regional heads to save the health of their respective people without any reason," concluded the PDIP politician.

Previously, the Coordinating Minister for Maritime Affairs and Investment, Luhut Binsar Panjaitan, also conveyed the threat of termination for regional heads who do not follow the rules when announcing the Emergency PPKM policy, Thursday, July 1.

According to him, the central government will take firm action against regional heads who are not serious in implementing Emergency PPKM with administrative sanctions in the form of written warnings twice in a row.

"This is very important to know. In the event that the governor, regent and mayor do not implement the provisions for tightening community activities during the emergency PPKM period, they will be subject to administrative sanctions in the form of written warnings twice in a row up to temporary dismissal," said Luhut in a virtual press conference, Thursday, July 1st.

Luhut said that the threat of sanctions refers to Article 68 paragraph (1) and paragraph (2) of Law Number 23 of 2014 concerning Regional Government.

Article 68 Paragraph (1) states that regional heads and/or deputy regional heads who do not implement national strategic programs are subject to administrative sanctions in the form of a written warning by the Minister for governors and/or deputy governors and by governors as representatives of the Central Government for regents and/or deputy regents. or mayor and/or deputy mayor.

Meanwhile, Article 68 Paragraph (2) states that in the event that the written warning as referred to in paragraph (1) has been delivered 2 (two) times in a row and is still not implemented, the regional head and/or deputy regional head are suspended for 3 months.

"This, the detailed arrangements will be issued by the instructions of the Minister of Home Affairs," said Luhut.
