Komnas HAM: There Is A Difference In Legal Basis Between KPK And BKN Regarding The Implementation Of TWK

JAKARTA - Komnas HAM Monitoring and Investigation Commissioner Mohammad Choirul Anam said there was a difference in the legal basis or legal standing between the Corruption Eradication Commission (KPK) and the State Civil Service Agency (BKN) in the implementation of the National Insight Test Assessment (TWK).

This was conveyed after Komnas HAM received information from the Deputy Chair of the KPK, Nurul Ghufron, who was present to clarify allegations of human rights violations in the implementation of the TWK.

"We got something a little different between the standing that was told to us by the KPK and by the BKN," Anam told reporters at his office, Jalan Latuharhary, Central Jakarta, Thursday, June 17.

Given these differences, Komnas HAM will continue to deepen it. Moreover, this different information has a big influence in the process of transferring the status of KPK employees.

However, Anam refused to elaborate further. Because this is related to the ongoing investigation.

"There is a substantial issue where this has a big influence on why there are 75 results and 1,200 results. Substantially it exists and technically it also exists. So we can't mention it," he explained.

Previously reported, Deputy Chairperson of the Corruption Eradication Commission (KPK) Nurul Ghufron completed an examination at Komnas HAM regarding the polemic of the National Insight Test (TWK) which was reported by employees.

Ghufron said that he had conveyed everything regarding the implementation of the TWK. One of them is related to the legal basis for conducting tests for employment status.

In addition, Ghufron as a representative of five KPK leaders explained about the implementation of TWK to the inauguration of their employees as ASN. This was conveyed in the examination which was held from 10.30 WIB until around 15.00 WIB.

"So we explained to Komnas HAM regarding legal standing, the legal basis of authority, then regulatory policies, and the implementation of the transfer of KPK employees to ASN which was carried out on June 1, 2021," said Ghufron to reporters at the Komnas HAM Office, Jalan Latuharhary, Central Jakarta, Thursday, June 17.

"Then Perkom Number 1 of 2021 was born regarding the Transfer of the Status of KPK Employees to ASN, which is a regulatory policy," he added.

For information, the National Insight Test was attended by 1,351 KPK employees. Of these, 1,274 people were declared eligible.

Meanwhile, 75 employees including senior investigator Novel Baswedan, Chairman of the KPK Employee Forum who is also investigator Yudi Purnomo, Director of Socialization and Anti-Corruption Campaign Giri Suprapdiono, Head of the KPK Task Force Harun Al-Rasyid, and Director of PJKAKI Sujarnarko who will retire, were also declared ineligible ( TMS). While the other two employees did not attend the interview test.

According to the employees who took this test, there were a number of irregularities in the implementation of the assessment. Including the questions asked by the assessor or assessor during the interview process.

The employees said the questions asked during the TWK process violated the private sphere. These irregularities were later reported by dozens of these employees to Komnas HAM, Komnas Perempuan, to the Indonesian Ombudsman.
