Legal Expert: If Team 9 Fails, KPK Must Take Over the Febrie Adriansyah Case

JAKARTA - Criminal law expert Prof. Romli Atmasasmita emphasized that the Corruption Eradication Commission (KPK) must take over the handling of cases that ensnare former Deputy Attorney General for Special Crimes (Jampidsus) Febrie Adriansyah if the 9th Attorney General's Team is unable to complete the investigation or faces serious obstacles.

According to Romli, the mechanism for the acquisition of cases by the KPK has been regulated in the provisions of laws and regulations so that it can be applied to ensure that the law enforcement process continues to run independently and effectively.

"If the investigation process faces serious obstacles within a certain period of time, there is a legal mechanism that allows the KPK to take over the handling of cases in accordance with the provisions of laws and regulations," Romli said in his statement, Thursday, July 30.

Romli assessed that handling the case of the former Jampidsus must be carried out carefully, objectively, and based on valid evidence. According to him, the investigation process must not be influenced by speculation or opinions that develop in the public space.

"The investigation must not be rushed. All stages must be carried out objectively, professionally, and in accordance with the provisions of the Criminal Procedure Code so that the results can really be held accountable," he said.

He explained that the alleged corruption and money laundering crimes (TPPU) had a connection that must be proven through a comprehensive investigation process.

According to Romli, investigators need to uncover the entire chain of events, ranging from the examination of witnesses, the collection of evidence, to the tracing of alleged flows of funds and assets related to the case.

"This matter cannot be concluded only from opinions circulating on social media. The main focus must remain on legal facts," he said.

Romli added that in criminal law, alleged corruption and TPPU have a causal relationship so that the proof must be carried out carefully and thoroughly.

"Both cases have a cause and effect relationship, so the proof must be carried out carefully," he said.

He also supports the steps of investigators to examine all parties suspected of having links to the former Jampidsus to uncover the legal facts in full.

"Therefore, investigators are expected to examine various parties, including people who know the activities of the former Jampidsus and other parties suspected of having links to the case," said Romli.

According to Romli, this case is an important test for the Indonesian law enforcement system. Therefore, if the 9th Attorney General's Team is unable to fully uncover the case or faces serious obstacles, the KPK needs to exercise its authority to take over the case to maintain independence and public trust.

"The public is now waiting to see whether all the facts will be revealed transparently, independently, and without prejudice," he concluded.
