The Ministry of Communication and Digital Studies the Supreme Court's Decision on the Rules of Internet Quota Residue

JAKARTA - The Ministry of Communication and Digital (Kemkomdigi) welcomes and respects the decision of the Constitutional Court (MK) which requires telecommunications service providers to provide service options that guarantee the remaining quota of active and usable fixed customer internet.

Minister of Communication and Information Technology Meutya Hafid emphasized that the Ministry of Communication and Information would study the Supreme Court's decision comprehensively as a basis for adjusting the applicable regulations.

"We welcome the Constitutional Court's decision. Today, we have ordered the team to study the implications of the decision, including if necessary adjustments to regulations to comply with the Constitutional Court's decision," Meutya said in Jakarta, Friday.

It is known that the Constitutional Court has just decided on a lawsuit related to the case of wasted internet quotas in a material test of Law Number 6 of 2023 concerning the Regulation of the Government Regulation to Replace Law Number 2 of 2022 concerning Job Creation into a law that amends Law Number 36 of 1999 concerning Telecommunications.

Through the decision Number 273/PUU-XXIII/2025, the Constitutional Court granted a portion of the lawsuit and stated that telecommunications network and service providers must provide service options that ensure that the remaining quota of the customer's internet is active and can be used.

The Constitutional Court also ordered that the internet quota that had been purchased could be used until it was exhausted without any additional cost.

According to the Constitutional Court, consumer protection can be realized through various schemes, including accumulation or rollover quotas, extension of active life, transfer of benefits, compensation, refund, and other proportional forms of protection.

The MK's ruling also emphasizes that prepaid and postpaid service users who have paid for internet quotas but have not spent it are still entitled to protection for the benefits of the services that have been paid for.

Kemkomdigi emphasized its commitment to oversee the implementation of this decision so that the rights of the public as consumers are well protected, without neglecting the aspects of investment sustainability and the quality of telecommunications networks in the country.

"We ensure that every policy in the telecommunications sector provides legal certainty and protects the interests of the community," said Meutya.
