Former Police Officer Accused of Brigadier General Nurhadi's Death Files Appeal

MATARAM - Former middle-ranking police officer, I Made Yogi Purusa Utama, who is a defendant in the case of the death of Brigadier Muhammad Nurhadi at the Gili Trawangan resort, has filed a cassation appeal against the appeal ruling at the West Nusa Tenggara High Court.

"Yes, we are appealing to the Supreme Court through the Mataram District Court," said Suhartono, the lawyer for the defendant Made Yogi in Mataram, Monday, June 8, reported by ANTARA.

One of the considerations of the defendant in his last position as Head of Sub-Directorate I of the Paminal Bidpropam of the NTB Police was related to the verdict which was considered not fundamental to the facts of the trial at the first level of the judicial system.

"So, here we are not only talking about the sentence. But, the sentence imposed in consideration is not in accordance with the evidence and facts at the trial," he said.

The NTB High Court in the Made Yogi appeal decision changed the prison sentence from 14 years in the first-instance court system to 15 years.

The indictment stating that Made Yogi was found guilty is still related to the crime of murder and obstruction of disclosure of a crime or removal of evidence (Obstruction of Justice) as in the first and second indictments of the public prosecutor.

This is in accordance with the criminal elements stipulated in Article 458 paragraph (1) of Law Number 1 of 2023 concerning the Criminal Code and Article 221 paragraph (1) of the Criminal Code in conjunction with Article 20 letter a or c of Law Number 1 of 2023 concerning the Criminal Code.

Unlike other defendants, namely I Gde Aris Chandra Widianto who was sentenced to three years in prison. The sentence for Made Yogi's former subordinate was lower than the first instance court's verdict which sentenced him to eight years in prison.

Aris was sentenced to 10 years in prison for violating Article 354 paragraph (2) of Law of the Republic of Indonesia No. 1 of 2023 concerning severe persecution causing death and Article 221 paragraph (1) of the Criminal Code in conjunction with Article 20 letter a or c of Law Number 1 of 2023 concerning the Criminal Code.

NTB Prosecutor's Spokesperson Harun Al Rasyid responded to Made Yogi's next legal step by saying that his party would prepare a counter-memorandum of cassation.

"If they appeal, we just submit a counter-memorandum of appeal. It's different from Aris, because we feel that there is still less consideration of the sentence, about the sense of justice, that's why we appeal," said Harun.
