Padang Prosecutor Executes 1 Convict in Illegal Mining Case Sentenced to 2 Years in Prison

JAKARTA - The joint team of the Padang District Attorney's Office (Kejari), West Sumatra (Sumbar) executed one convicted illegal mining case on Tuesday, May 5.

Head of the Intelligence Section of the Padang District Attorney's Office, Eriyanto, explained that the executed convict was male on behalf of Bogi Restu Ilahi.

"Today's convicts were executed and immediately taken to the Padang Detention Center (State Prison) to serve their sentences," he said in Padang, Wednesday, May 6, quoted by Antara.

He explained that the basis for the execution was the cassation decision of the Supreme Court of the Republic of Indonesia (MA) which stated that the convict was legally and convincingly guilty.

The Supreme Court sentenced the convict to two years in prison, as well as a fine of Rp50 million, which was subject to five months in prison.

"In addition to executing the convicts, the Padang District Attorney's Office has also seized one unit of an excavator to be confiscated as per the Supreme Court's decision," he said.

The execution was carried out by the Public Prosecutor (JPU) who handled the case, namely Hafiz Zainal Putra, and Irawati, while the convicts were directly accompanied by legal advisors.

Meanwhile, the Head of the General Criminal Section of the Padang District Attorney's Office, Raden Hairul Sukri, said that during his journey the case had three court rulings in a row.

At the level of the District Court, the convict was sentenced to two years in prison and a fine of Rp. 50 million, plus five months in prison.

The same sentence was also imposed on the convicts at the appeal level at the High Court and the cassation decision of the Supreme Court of Indonesia.

"The punishment is the same, the difference is the status of the heavy equipment seized as evidence in this case," he explained.

Until finally the Constitutional Court decided that one unit of heavy equipment was confiscated for the state, while the other unit was returned.

He explained that the heavy equipment seized for the state had been confiscated for auction, the next process would be carried out by the State Evidence and State Seizure Management Unit of the Padang District Court.

The case that ensnared the convicted person began on December 3, 2024, when the Padang City Police carried out law enforcement against illegal mines in the Sarik River area, Kuranji District, Padang.

At the activity, the team found illegal mining activities of c mining which were suspected of being illegal because they could not show the necessary documents and permits as required by law.

The case then continued to the investigation, prosecution, and trial stages, starting from the first level, appeal, then cassation.
