Lawyer Highlights Alleged Misidentification in Charges in BUMD KKT Case

JAKARTA - The legal team for the former Regent of the Tanimbar Islands (KKT), Petrus Fatlolon, highlighted the alleged error of identity in the prosecutor's demand letter (JPU) at the trial of the alleged corruption case of the KKT BUMD at the Ambon Tipikor Court, Wednesday, April 22.

In the reading of the defense note (pledoi), the team of lawyers said the prosecutor listed an identity that did not match the defendant. In the indictment document, the legal subject is referred to as a man born in Lamongan in 1991 who resides in Malang and is a former state-owned enterprise employee.

Meanwhile, the defendant on trial is Petrus Fatlolon, a former regional head aged 59.

The head of the legal team, Fahri Bachmid, assessed the error as a fatal mistake that had implications for the validity of the lawsuit.

"If the identity of the legal subject is changed, then the claim is formally defective and potentially null and void," said Fahri in the trial.

Apart from the issue of identity, the legal team also revealed a number of other irregularities in the investigation and prosecution process. They highlighted the alleged discrepancy in the Examination Report (BAP), including the location of the examination of witnesses which was said to be inconsistent with that stated in official documents.

The team also questioned the validity of the evidence submitted by the prosecutor, because most of them were photocopies without original documents. In fact, it is said that there are important documents that are not accompanied by the signature of the authorized official.

On this basis, the lawyer assessed that the charges against his client were not supported by strong evidence and asked the panel of judges to acquit Petrus Fatlolon from all charges.

"We ask the panel of judges to acquit the defendant of all charges and restore his good name," said Fahri.

Until this news was written, the prosecutor's office has not given an official response regarding the defense argument. The trial is still continuing with the next agenda according to the trial schedule.
