JAKARTA - The National Human Rights Commission (Komnas HAM) will ask the TNI Commander General TNI Agus Subiyanto about the involvement of his personnel in the case of pouring hard water on KontraS activist Andrie Yunus on Thursday (12/3) evening.
"Komnas HAM will soon call the TNI Commander to ask for an explanation regarding the involvement of its members in the Andrie Yunus case as an offender," said Komnas HAM Chairperson Anis Hidayah in a statement reported by ANTARA, Thursday, March 19.
He said that the difference in the initials of the perpetrators revealed by the TNI Headquarters and the National Police of the Republic of Indonesia (Polri) needed to be further clarified. As for the two names of the initials known, namely BHC and BHW are the same person according to the Police.
"Regarding the TNI, of course this needs to be clarified, but regarding the initials BHC and BHW, according to the National Police, it is the same person but uses different initials," he said.
According to him, Komnas HAM is currently investigating the case further and his party is building intensive coordination with the Metro Jaya Police in completing the investigation process.
"Komnas HAM has so far carried out intensive communication and coordination with the Polda Metro Jaya and we have sufficient information related to the suspects, then also the evidence, yes, and so on," he said.
Furthermore, Anis encouraged the case to be processed through the general court to distinguish between military delicts and general crimes because the victims involved are civilians.
"Komnas HAM itself encourages this case to be processed through the general court, because the TNI should not be privileged so that impunity or crime without punishment occurs. Moreover, if you read this case, this is not related to military crimes related to military crimes because in this case the victim is a civilian," he said.
Then also, said Anis, human rights activists who have been making advocacy efforts related to human rights, especially related to the work of the TNI and their actions are acts regulated in the Criminal Code, are not related to military service duties.
Based on the ratification of international conventions for civil and political rights that have been ratified by the Indonesian Government, said Anis, the state has an obligation to investigate immediately, adequately, transparently, independently, and accountable.
"In military courts, access has been closed to the public so we encourage how this trial is transparent, accountable and also accessible to the public and considering many things above, we want to encourage the process through the general court," he said.
Previously, the Commander of the TNI Police Center (Puspom) Major General TNI Yusri Nuryanto said the TNI Military Police Center (Puspom) had detained four TNI personnel for alleged involvement in the Andrie Yunus hard water spraying case.
"So, now the four suspects are being detained at the TNI Puspom for further investigation," he said.
Yusri also confirmed that the four people detained by the TNI Puspom were members of the TNI who served in the Strategic Intelligence Agency Headquarters (Denma BAIS) TNI. The four perpetrators have the initials NDP, SL, BWH, and ES.
"We convey that all four suspected perpetrators are members of the Denma BAIS TNI. So, it's not from any unit, but from the Denma BAIS TNI," he said.
