JAKARTA - President Prabowo Subianto has officially signed Government Regulation (PP) Number 48 of 2025 concerning the Regulation of Land and Land Reclamation Areas. Through this policy, the government has full authority to confiscate unproductive land that is deliberately left by permit holders or land rights holders.

This step was taken to optimize the utilization of land throughout Indonesia. The government can now rearrange the areas that are concessions or permits that are deliberately not worked or not used according to their provisions.

"Areas that have permits, concessions, or permits that are deliberately not attempted, not used, and/or not used [will be designated] as objects for regulating abandoned areas," the policy reads, quoted on Monday, February 9.

Meanwhile, the land objects that fall into the category of state seizure include strategic sectors, ranging from mining areas, plantations, industries, tourism, to housing.

Technically, this regulation targets land with the status of Rights to Use (HGU), Rights to Use Buildings (HGB), Rights to Use, to Rights to Manage (HPL).

"Land that has been designated as Abandoned Land, within a maximum period of 30 calendar days from the determination, must be vacated by the former Right Holder, Management Right Holder, or Land Ownership Holder," reads Article 32 of the PP.

However, specifically for land with the legality of a Certificate of Ownership, the state cannot take over unless it is proven that the owner deliberately does not use, does not utilize, and does not maintain the land within a certain period of time.

Previously, the government did plan to revise Government Regulation (PP) Number 20 of 2021 concerning the Regulation of Land and Land Areas.

Previously, the Minister of Agrarian and Spatial Planning/Head of the National Land Agency (ATR/BPN) Nusron Wahid explained that one of the points that was revised was regarding the period of the takeover process.

In the old policy, the series of land reclamation took a long time to reach 587 days. However, the process is now cut to 90 days according to President Prabowo Subianto's instructions.

"Based on the PP, it took 587 days. Therefore, at the order of President Prabowo, for the sake of the people, we ordered a revision. The revision order is clear, the process will be shortened to only 90 days," he explained at the Indonesian Parliament Complex, Wednesday last week.
