JAKARTA - The National Human Rights Commission (Komnas HAM) said that until now there are still complaints from the public regarding the alleged case of torture in the series of riots in August-September 2025.
Chairman of Komnas HAM Anis Hidayah said that on Monday morning, there were 60 representatives of the victims' families who complained about the alleged torture to his party. According to him, the representatives of the victims' families came from the North Jakarta area.
"There are still complaints, especially from the aspect that they feel that there is a legal process that they indicate has not occurred fairly, so they ask Komnas HAM to participate in providing attention," said Anis at the Komnas HAM Office, Jakarta, Antara, Monday, December 22.
He explained that they claimed that their brother or sister was a victim of alleged torture during the arrest, examination, and subsequent legal process. Currently, he said, the victims are in the trial process.
In this case, he said Komnas HAM is still processing the settlement of reports related to the Joint Fact-Finding Team (TGPF) for the August 2025 riots. According to him, Komnas HAM will also coordinate with other institutions that are members of the TGPF.
"We have to wait for how the position of each institution is related to the report that is being formulated at the level of their respective agencies first," he said.
Meanwhile, a representative of the Victims' Family and the Young Movement Against Criminalization, Sarah urged Komnas HAM to immediately intervene to conduct a thorough investigation into alleged human rights violations committed by the North Jakarta Police.
He said his party had found strong evidence that the legal process against dozens of residents after the August 2025 action was fraught with acts of torture, wrongful arrest, and the abandonment of fundamental constitutional rights.
The criminalization, he said, began with the efforts of the police to trap residents with Article 170 of the Criminal Code concerning Pengeroyokan and Article 212 jo. 214 of the Criminal Code regarding resistance against officials who are on duty.
"Based on the facts of the trial and the testimony of the police witnesses, this incident was proven to be completely unrelated to the previous case of vandalism of the house of a DPR member," said Sarah.
According to him, a number of residents were criminalized just because they used toothpaste on their faces to protect themselves from exposure to tear gas. Moreover, the arrests were carried out from 02.30 to 06.00 WIB when the situation had started to be conducive and residents were carrying out normal activities such as trading or going home from work.
"This is exacerbated by the fact that the majority of the defendants are only residents who are in the back row to watch and have no intention of committing violence," he said.
Therefore, he conveyed that the Young Movement Against Criminalization demanded the National Human Rights Commission to immediately conduct an independent investigation by deploying a monitoring team to investigate the alleged physical and mental torture experienced by detainees at the North Jakarta Police.
Then, he also asked Komnas HAM to issue a recommendation for release by giving a legal recommendation that the process of arresting the residents was defective in procedure and was a victim of wrongful arrest.
"Ensuring the police stop repressive ways in every legal process for all political prisoners," he said.
